CITY COUNCIL STAFF REPORT

To: Mayor Bairos and Members of the City Council
From: Andrew Stever, Police Lieutenant
Reviewed by: Jerry Ramar, City Manager
Subject: Consider a Resolution Adopting Application Fees, Annual Permit Fees, and Re-inspection Fees for the Smoke Shop Permit Program.
BACKGROUND
On July 20, 2026, Staff presented the first reading of an ordinance adopting Chapter 38 Smoke Shop Regulations and adding Article IV Tobacco Retailer License Limitation Section 24 to Chapter 16 Licenses, Establishing Regulatory Oversight of Smoke Shop businesses. This was approved by City Council.
The second reading is scheduled for August 3, 2026, and will be on the Consent Agenda.
The City of Oakdale is pursuing this regulatory program in response to a noticeable increase in juvenile use of tobacco, vaping, and related products, as well as a growing number of smoke shop businesses within the community.
DISCUSSION
The proposed fee structure is intended to support cost recovery through permit fees, the role of law enforcement and code enforcement in ensuring adherence to state and local laws, and the need to limit the number of establishments over time. Additionally, the discussion emphasizes concerns related to underage access to tobacco and vaping products, as well as the environmental and public health risks associated with hazardous materials found in electronic vaping devices and cartridges. Permit fees will help offset the costs incurred by the Oakdale Police Department for the proper handling and disposal of seized vaping devices and cartridges, which qualify as e-waste and require specialized, non-routine disposal methods
Overall, the program is intended to promote accountability, protect youth, and preserve the safety and character of the Oakdale community.
FISCAL IMPACT
There is no cost to the general fund.
RECOMMENDATION
Staff recommends that the City Council adopt a Resolution Adopting Application Fees, Annual Permit Fees, and Re-inspection Fees for the Oakdale Municipal Code Smoke Shop Permit Program.
