RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE CLAIM OF
BROOKLYN BASIN BAR GROUP DBA SEAWOLF , CITY ATTORNEY
FILE NO. C 34637, IN THE AMOUNT OF FIFTY THOUSAND THREE HUNDRED THIRTY DOLLARS AND SIXTY-NINE CENTS ($50,330.69) (PUBLIC WORKS – FAILED SEWER MAIN)
WHEREAS, Brooklyn Basin Bar Group dba Seawolf alleges that on December 1, 2020, the City’s sewer main caused damage to their business establishment including spoilage to food/beverages, as well as damage to supplies, e quipment, and its facility which prevented it from operating; and
WHEREAS, Brooklyn Basin Bar Group dba Seawolf filed the above entitled claim seeking payment for said damages; and
WHEREAS, the City of Oakland has determined that settlement in this amount, without an admission of liability, is in the best interest of the City; now, therefore, be it
RESOLVED: That the City Attorney is authorized and directed to compromise and settle the case of Brooklyn Basin Bar Group dba Seawolf, City Attorney’s File No. C34637, for the sum of Fifty Thousand Three Hundred Thirty Dollars and Sixty-Nine Cents ($50,330.69); and be it
FURTHER RESOLVED: That the City Administrator is authorized and directed to issue settlement payments as negotiated by the City Attorney with Brooklyn Basin Bar Group dba Seawolf; and be it
FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps may be necessary to effect said settlement.
