RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE CASE OF LINDA
RUSSELL V. CITY OF OAKLAND, AND DOES 1-20, ALAMEDA COUNTY SUPERIOR COURT CASE NO. RG19017369 , CITY ATTORNEY’S FILE NO. 33090, IN THE AMOUNT OF SIXTY -FIVE THOU SAND DOLLARS AND NO CENTS ($65,000) (DEPARTMENT OF TRANSPORTATION –
DANGEROUS CONDITION OF PUBLIC PROPERTY)
WHEREAS, Plaintiff Linda Russell allegedly tripped and fell on the sidewalk on 8th Street near Adeline Street on August 6, 2018; and
WHEREAS, Plaintiff Russell alleges she sustained a fractured knee and wrist, requiring medical treatment; and
WHEREAS, Plaintiff Russell filed Linda Russell v. City of Oakland , Alameda County Superior Court Case No. RG19017369 against the City of Oakland alleging dangerous condition of public property;
WHEREAS, without admitting fault or wrongdoing, the City has determined to compromise Linda Russell’s claim for the sum of Sixty -Five Thousand Dollars and no Cents ($65,000.00); now therefore be it
RESOLVED: That the City Attorney is authorized and directed to compromise and settle the case of Linda Russell v. City of Oakland , and DOES 1-20, Alameda County Superior Court Case No. RG19017369 , City Attorney’s File No. 33090, for the sum of Sixty -Five Thousa nd Dollars and No Cents ($65,000.00); and be it
FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps as may be necessary to effect said settlement.
