RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE CLAIM OF BEST
INSTRUMENT REPAIR AND A&G MUSIC / DICK AKRIGHT , CITY
ATTORNEY FILE NO. C 34483, IN THE AMOUNT OF THIRTY-FOUR
THOUSAND FIFTY -FIVE DOLLARS AND THIRTY-FIVE CENTS
($34,055.35) (DEPARTMENT OF PUBLIC WORKS – FAILED SEWER MAIN)
WHEREAS, Best Instrument Repair and A&G Music / Dick Akright alleges that on December 14, 2020, the City’s sewer main caused damage to business property which included music instruments, accessories, and books; and
WHEREAS, Best Instrument Repair and A&G Music / Dick Akright filed the above entitled claim seeking payment for said damages; and
WHEREAS, the City of Oakland has determined that settlement in this amount, without an admission of liability, is in the best interest of the City; now, therefore, be it
RESOLVED: That the City Attorney is authorized and directed to compromise and settle the case of Best Instrument Repair and A&G Music / Dick Akright , City Attorney’s File No.
C34483, for the sum of Thirty-Four Thousand Fifty-Five Dollars and Thirty -Five Cents ($34,055.35); and be it
FURTHER RESOLVED: That the City Administrator is authorized and directed to issue settlement payments as negotiated by the City Attorney with Best Instrument Repair and A&G Music / Dick Akright; and be it
FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps may be necessary to effect said settlement.
