President Fortunato Bas and Members of the City Council:
Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above -entitled lawsuit for the sum of: Thirty Five Thousand Dollars and No Cents ($35,000.00), payable to Plaintiffs in an allocation of $33,500.00 to Plaintiff Le and $1,500.00 to Plaintiff Nguyen, in a manner specified by Plaintiffs’ counsel.
This action arises from an August 26, 2018 automobile accident involving a Department of Transportation vehicle at the intersection of East 18th Street and 4th Avenue. A City of Oakland-owned white Toyota Prius driven by City of Oakland parking enforcemen t officer Nicole Carden collided with two pedestrians in the crosswalk, while the pedestrians were crossing the street with a green light.
The City Council authorized settlement of this case in Closed Session on T hursday, July 21, 2022 (moved by Councilmember Sheng Thao and seconded by Councilmember Noel Gallo – 6 Ayes (Bas, Thao, Gallo, Taylor, Reid, Kaplan), 0 Noes, 2 Absent/Excused (Fife, Kalb) and 0 Abstentions).
