HONORABLE CITY COUNCIL
Oakland, California

Subject: Sandra Parrott v. City of Oakland, and DOES 1 – 25, inclusive Alameda County Superior Court Case No. RG20063194
City Attorney File No. 33806
(Department of Transportation – Dangerous Condition of Public Property)

Dear President Fortunato Bas and Members of the City Council:

Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled claim for the sum of Five Hundred Thousand Dollars and No Cents ($500,000.00), payable to Abronson Law Offices on behalf of Sandra Parrott.

This action arises out of Plaintiff’s trip and fall over an uplift in the sidewalk on Stanford Ave. in Oakland on June 5, 2019. The uplift was allegedly caused by roots of a nearby official City tree. As a result of the fall, Plaintiff fractured the right big toe, which after extensive treatment and mult iple surgical procedures was eventually amputated. Plaintiff claims past and future medical expenses, loss of income, and pain and suffering.

The City has determined that settlement in the amount of $ 500,000.00, without admitting liability and to avoid further litigation, is in the best interest of the City.

The City Council authorized settlement of this case in Closed Session on Thursday, December 8, 2022 (moved by Councilmember Loren Taylor and seconded by Councilmember Dan Kalb - 5 Ayes and 3 Absent – President Pro Tempore Sheng Thao, Council President Nikki Fortunato Bas and Councilmember Carroll Fife).

Respectfully submitted,

BARBARA J. PARKER
City Attorney

Assigned Attorney:

Christina Lum
