HONORABLE CITY COUNCIL
Oakland, California

Subject: Lynn Mladjov and Vassil Mladjov v. City of Oakland and DOES 1 to 100
Alameda County Superior Court Case No. RG20082462
City Attorney File No. 34128
(Department of Transportation – Dangerous Condition of Public Property)

Dear President Fortunato Bas and Members of the City Council:

Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing the compromise and settlement of the above-entitled claim for the sum of Eighty-Five Thousand Dollars and Zero Cents ($85,000.00), which is apportioned and payable to Plaintiff Lynn Mladjov for $80,000.00 and Plaintiff Vassil Mladjov for $5,000.00 , through Plaintiffs’ attorneys at Liuzzi, Murphy, Solomon, Churton, Hale & Winnett, LLP.

Plaintiff Lynn Mladjov alleges that on April 17, 2020, Plaintiff was injured while walking on the sidewalk near 644 Trestle Glen Road due to a sidewalk uplift. Ms. Mladjov fell to the ground and was later diagnosed with a fracture of the right radial head of the right elbow, tor n labrum (cartilage) in the right shoulder, and sprain of a finger. Plaintiff Vassil Mladjov alleges loss of consortium for decreased marital emotional support and companionship and household services from wife Lynn Mladjov . The City has determined that se ttlement in the total amount of $85,000.00 to Plaintiffs, without admitting liability and to avoid further litigation, is in the best interest of the City.

The City Council authorized settlement of this case in Closed Session on Thursday, December 8, 2022 (moved by Councilmember Loren Taylor and seconded by Vice Mayor Rebecca Kaplan - 5 Ayes and 3 Absent – President Pro Tempore Sheng Thao, Council President Nikki Fortunato Bas and Councilmember Carroll Fife).

Respectfully submitted,

BARBARA J. PARKER
City Attorney
