President Fortunato Bas and Members of the City Council:
Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled claim for the sum of One Hundred Seventy Thousand Dollars and Zero Cents ($ 170,000.00), payable to Plaintiffs Hoa Nguyen, Michelle Nguyen, John Nguyen, and Ellie Nguyen, through Plaintiffs’ attorneys, the Law Offices of Richard W. Meier.
This action against the City of Oakland and others arises out of an accident that occurred on October 1, 2019, when Defendant Lilia Vargasdoralla drove through the crosswalk at 22 nd Avenue and Foothill Boulevard and struck Plaintiff Ellie Nguyen and Huong Truong . Pla intiff Ellie Nguyen allegedly suffered serious injuries and Huong Truong died. Plaintiffs allege the intersection was a dangerous condition of public property. The City has determined that settlement in the amount of $170,000.00, without admitting liability and to avoid further litigation, is in the City’s best interest.
The City Council authorized settlement of this case in closed session on Thursday, January 19, 2023 (moved by Council President Nikki Fortunato Bas and seconded by Councilmember Noel Gallo - 8 Ayes.
