This matter is listed as Item No. 1(b) on the Closed Session Agenda:
The Council authorized settlement in the amount of $50,000.00.
This case arose out of an incident occurring on August 3, 2019.
FACTS/ISSUES:
Plaintiff Karen Saucedo (“Saucedo”) alleges that on August 3, 2019, Saucedo tripped and fell on broken sidewalk concrete while walking on Wellington Street towards the intersection with Park Boulevard in Oakland . S aucedo was diagnosed with multiple fractures in the left wrist, a torn scapholunate ligament in the left wrist, and post-concussive symptoms due to this incident.
Saucedo sued the City, alleging the pothole was a dangerous condition of public property.
The City has determined that settlement in the amount of $50,000.00 to Saucedo, without admitting liability and to avoid further litigation, is in the best interest of the City.
The approved settlement resolves all of Saucedo’s claims in this matter.
