RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE EEOC CHARGE
NO. 555-2017-01062 OF HELEN RICCI AGAINST THE OAKLAND
POLICE DEPARTMENT, IN THE AMOUNT OF ONE HUNDRED
THOUSAND DOLLARS AND ZERO CENTS ($100,000.00) (OAKLAND
POLICE DEPARTMENT - EMPLOYMENT DISCRIMINATION AND
RETALIATION)
WHEREAS, on Feb ruary 3, 20 17, the Oak land Police Department ("OPD ") informed Helen Ricci ("Ricci ") that it had scree ned Ricci out from further consideration for hire because of a pending lawsuit that Ricci fi led against Ricci 's form er emp loyer ; and WHEREAS, on August 8, 20 17, Ricci filed an emp loyment discrimination and retaliation charge with the Equal Employment Opportunity Commission ("EE OC ") alleging that OPD had discriminated and retaliated against Ricci because of Ricci 's engagement in a protected activity (fi ling a lawsuit) in violation of Title Vll of the Civi l Right s Act of 1964 ("Title VII''); and ;
WHEREAS, the City has cons idered all the evidence, litigation costs, and litigat ion risks in this case ; and
WHEREAS, the City admit s no wrongdoing or liabilit y; and WHEREAS, the City has determin ed to compromise Ricci 's EEOC charge for the sum of One Hundred Thousa nd Dollar s and Zero Ce nts ($100.000.00); now , ther efore , be it RESOLVED: That the City Attorney is authorized and directed to compromise and settle the EEOC Charge no. 555-2017-0106 of Helen Ricci, for the sum of One Hundred Thousand Dollars and Zero Cents ($100,000.00) ; and be it FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps as may be necessary to effect said settlement.
