RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE EEOC CHARGE
NO. 555-2017-01062 OF HELEN RICCI AGAINST THE OAKLAND
POLICE DEPARTMENT, IN THE AMOUNT OF ONE HUNDRED
THOUSAND DOLLARS AND ZERO CENTS ($100,000.00) (OAKLAND
POLICE DEPARTMENT – EMPLOYMENT DISCRIMINATION AND
RETALIATION)
WHEREAS, on February 3, 2017, the Oakland Police Department (“OPD”) info rmed Helen Ricci (“Ricci”) that it had screened Ricci out from further consideration for hire b ecause of a pending lawsuit that Ricci filed against Ricci’s former employer; and
WHEREAS, on August 8, 2017, Ricci filed an employment discrimination an d retaliation charge with the Equal Employment Opportunit y Commission (“EEOC”) alleging that OPD had discriminated and retaliated against Ricci because of Ricci’s engagement in a protected activity (filing a lawsuit) in violation of Title VII of the Ci vil Rights Act of 1964 (“Title VII”); and;
WHEREAS, the City has considered all the evidence, litigation costs, and litigation risks in this case; and
WHEREAS, the City admits no wrongdoing or liability; and
WHEREAS, the City has determined to compromise Ricci’s EEOC charge for t he sum of One Hundred Thousand Dollars and Zero Cents ($100,000.00); now, therefore, be it
2 RESOLVED: That the City Attorney is authori zed and directed to compromi se and settle the EEOC Charge no. 555-2017-0106 of Helen Ricci, for th e sum of One Hundred Thousand Dollars and Zero Cents ($100,000.00); and be it
FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps as may be necessary to effect said settlement.
