RECOMMENDATION
CouncilPresidentBasRespectfullyRequestThatTheCityCouncilThatTheOaklandCityCouncilAdoptAnOrdinanceAuthorizingTheCityAdministratorToNegotiateAndExecuteALicenseAgreementWithTrybe,Inc.,ACaliforniaNonprofitOrganization,ToActivateTheSanAntonioParkTennisCourtsForTownNightsAndYear-RoundProgrammingForA1-YearTermWithTwo1-YearOptionsAtARateOfZeroDollars($0.00)PerYear, EffectiveJune1,2023;(2)MakingFindingsThatTheLicenseForBelowFairMarketValueIsInTheBestInterestOfTheCity;And(3)MakingAppropriateCaliforniaEnvironmentalQualityActFindings.
EXECUTIVESUMMARY
TherequestisfortheOaklandCityCounciltoapproveanOrdinancethatallowsTrybeInc.toexecuteyear-roundprogrammingontheSanAntonioTennisCourtsforabelow-marketrateof$0.00effectiveJune1,2023,untilJune11th,2024outoftemporaryprogrammingpods,whichtheorganizationwillinstallandmaintain.Thisordinancewillallowforprogrammingonunder-utilizedtenniscourtsformultiplemarginalizedcommunitiesandidentities,andbringanetgainofprogrammingresourcesintoanalreadyunderservedcommunity. ThepurposeofthisOrdinanceistoencouragemorepositivepartnershipsbetweentheCityandCommunityBasedOrganizationswhereourresidentsareservedmoreeffectivelyandinamoreaccessiblewayintheircommunities.
Inparticular, theprogrammingwillserveseniors,school-agedandtransitionalageyouth,infants/toddlersandcaregivers,andimmigrants/refugees.Programmingwillcenteronhealthandwellnessthroughactivity, youthdevelopmentcommunityresiliencethroughdistributionoffoodandotheressentials,emergencyresourcenavigation,andcommunitysafetyandcelebrationevents.Theinfrastructurebeingstoredwillbefour(4)programming‘pods’storedonthesecondofthefourcourts(seeExhibitA).

ThisitemwasscheduledtocomebeforethePRAC(ParksandRecreationAdvisoryCommission)onMay10th,however, thatmeetingwascanceled,andsubsequently, thisitemwouldmostlikelynotbeabletocomebeforePRACorLECbeforetheCouncil’srecess.ToensurethatTrybe,Inc.'sprogrammingcancontinueasscheduled,thisitemisbeingsubmittedwithanurgencyfindingtobebroughtbeforeCouncilonJune20th,2023.TheitemwillstillbebroughtbeforethePRAConJune14th,2023asamatterofprocessandcourtesy, however, sincethisisnotarequestforaMinorConditionalUsePermit,itisnotnecessarytogotoPRAC.
BACKGROUND/ LEGISLATIVEHISTORY
TrybeInc.is a nonprofitorganizationthatproposestoactivatetheSanAntonioParkthroughyear-roundprogrammingcenteredoncommunityresiliencethroughdistributionof foodandothernecessities,emergencyresourcenavigation,andcommunitysafetyandcelebrationeventsandserveseniors,school-agedandtransitionalageyouth,infants/toddlersandcaregivers,andimmigrants/refugeesintheSanAntonio,LittleSaigon,EastlakeandFruitvaleneighborhoodsinOakland.
TrybeInc.hasservedtheSanAntonioandsurroundingneighborhoodsfor15years,andoverthepastthreeyearshassupportedthecommunitythrougha multitudeoflevers:coordinatingandexecutingfoodgiveaways(the equivalentof 5.4 millionmealequivalentsas a singleorganization);resourcenavigationfairs(wherethey’vedistributedmorethan$23millioninfoodandotherresources),communityactions,eventsandmeetings,averaging40peryear;executingnecessaryprogrammingfor infants,youth,families,andseniorsin the SanAntonioandsurroundingareasthataddresseshealthdisparities,financialpreparedness,jobtraining,youthdevelopment,homelessness,andotherissues;and,TrybeInc.delivers1,000,000unitsofservicesandservesupwardsof21,000individualsannually, at least40%ofwhomareinthe94606areacode; TrybeInc.’srequestforaLicenseAgreementat$0.00iscenteredinthegoalofreactivatinganalreadyblightedandunderutilizedspacebyexecutingtargetedprogramming,resourcedistribution,andcommunityengagementforunder-resourcedcommunities.TrybeInc.cohabitatestheSanAntonioRecCenter, which,duetoitssize,provideslittletonoinsideorshelteredprogramming,storage,orofficespace.TrybeInc.intendstoexpandtheirprogrammingtotheSanAntonioTennisCourtstobothactivatethespace,aswellascreatemoreprogrammingspacetoserveinfants,youth,families,seniors,andotherresidentsinthesurroundingcommunity. Programmingwillalsoincludeandincorporateothercommunityorganizations,suchasVerticalSkills,StreetSoccerUSA,SoccerWithoutBorders,FriendsofSanAntonioPark,EBAYC,andotherstodeliverconsistent,impactfulprogrammingtotargetedcommunitiesaroundthepark.

PublicparksareacentralresourceforOaklandresidentsthatneedactivation,maintenance,andattention.Workingwithcommunityorganizationsthatofferfree,highqualityresourcesandopportunitiestoOaklandresidentsbyutilizingandactivatingunderresourcedCityspaces,theCitycanbetterunderstand,allocateresourcesto,andaddresstheneedsofsurroundingcommunities.
FISCALIMPACT
ThisleaseagreementbringsamultitudeofpositiveimpactsintotheSanAntonioandsurroundingneighborhoodsatnocosttotheCity, ortoresidents.TrybeInc.intendstoberesponsibleforandcontinueupkeepofthecourtsandhasalreadyallocatedfundsforthe Meetingof theOaklandCityCouncilJune20th, 2023

TheCityhasandcontinuestoofferuseofpropertytocommunityservingorganizationstoprovideservicesforbelow-marketrates.Othercomparable,below-marketratelease/licenseagreementsforin-kindservicesofcommunity-servingusesofCityproperty(someofwhichareparks)include:

PUBLICOUTREACH/ INTEREST
TrybeInc.,alongwithmultipleothercommunitypartners,hasbeenorganizingaroundbuildinguptheresourcesandservicescomingoutoftheSanAntonioPark,andthisisanaturalevolutionofthatorganizing.Whileprogrammingpodsarenotintendedtobepermanentstructures,itisanopportunityfortheCitytoworkwithcommunity-basedpartnerswhocanaddsignificantvaluebothtothephysicalofferings,andoverallsecurityofoneofourparks.TheFriendsofSanAntonioParkCoalition(FOSAP),hasalsoissuedaletterinsupportofTrybeInc.’suseofthetenniscourts.FOSAPisacoalitionformedinAprilof2021whichincludesEastBayAsianYouthCenter(EBAYC)andE.D.DavidKakishiba,Trybe,Inc.,andE.D.AndrewPark,EastsideArtsAllianceandCollectiveMemberElenaSerrano,LotusBloomandE.D.AngelaLouieHowardandDirectorofProgramsDawnEdwards,SanAntonioFamilyResourceCenterParentActionResearchTeamandcoordinatorLizSullivan,andSanAntonioParkStewardWendyJung,has

SUSTAINABLEOPPORTUNITIES
Economic: Trybe,Inc.offersresourcesthatsupporttheeconomicandphysicalwellbeingofresidents,particularlytheirfooddistributionsandgiveaways,whicharecriticaltomanyoftheimmigrant,senior, andlowincomefamiliesintheareawhostruggletoobtainfreshandunprocessed,orevenculturalfoods.ByexpandingTrybe,Inc.’sreachontothecourts,theCitycanpartnertosupportandincreasefooddistributionandothernecessaryresources.
Environmental: TheSanAntonioTennisCourtshavelongbeenindisrepairandunusableformostprogramming.Assuch,ithasbecomealesssafespaceinthepark.Throughactivatingthetenniscourtswiththisorganization,wecouldseeanimprovementinsafetyandwellbeingforpark-goers.Trybe,Inc.alsodoesaplethoraofprogrammingaroundbeautificationandenvironmentalJustice.
Race&Equity: Trybe,Inc.,servesprimarilyBIPOCresidentsintheSanAntonioandsurroundingcommunities,manyofwhomarelowincome,immigrantsorrefugees,orpartofanothermarginalizedcommunity. Thisaddsdirectandaccessibleresourcestoresidentsdirectlyintheircommunity.
