The Council authorized settlement in the amount of $112,000.00.
This case arose out of an incident occurring on March 13, 2020.
FACTS/ISSUES:
Plaintiff Marc Sims (“Sims”) alleges that on March 13, 2020, Sims was injured while riding a motorcycle when City employee Tanya Williams made a sudden left turn with her van across Sims’ lane of travel, causing Sims to collide into the passenger side of the van. Sims alleges that medical professionals diagnosed Sims with two fractured bones and a ligament tear in the right hand. Sims underwent surgery to repair the fractures and torn ligament . Sims was also diagnosed with traumatic brain injury.
Sims sued the City and Williams, alleging Williams was negligent when driving . The City has determined that settlement in the amount of $ 112,000.00 to Sims, without admitting liability and to avoid further litigation, is in the best interest of the City.
The approved settlement resolves all of Sims’ claims in this matter.
