Anglo Commercial Trucking, Inc.; State of California (CalTrans); and City of Oakland, California
Alameda County Superior Court Case No. RG21091611
City Attorney File No. 3441
(Oakland Department of Transportation – Dangerous Condition) President Fortunato Bas and Members of the City Council:

Pursuant to Section 401 of the Charter, the Ci ty Attorney has prepared and requests your approval of a resolution authorizing compromise a nd settlement of the above-entitled lawsuit for the sum of Five Hundred Thousand Dollars a nd Zero Cents ($500,000.00), payable to Franecke Law Group.

This action arises from a vehicle accident on August 22, 2020, at 12:39 a.m. on Frontage Road and 14th Street in Oakland, California. Decedent was driving a vehicle with two passengers, Plaintiff Destiny Seals, and decedent’s infant child, Plaintiff Milan F. Sahni.

Decedent traveled out of the northbound lane of travel on Frontage Road and collided with an illegally parked tractor trailer truck. Decedent died at the scene of the accident. Plaintiff Destiny Seals was severely injured. Plaintiff Milan F. Sahni was not physically injured. Plaintiffs filed a complaint in state court alleging one cause of action against the City for dangerous condition of its roadway, in part, based on the illegally parked truck. The City has determined that settlement in the amount of $500,000.00, without admitting liability and to avoid further litigation, is in the best interest of the City.

The City Council authorized settlement of th is case in Closed Session on Thursday, October 5, 2023 (moved by Councilmember Carroll Fife and seconded by Councilmember Kevin Jenkins - 7 Ayes, 1 Absent – Councilmember Noel Gallo).

Respectfully submitted,
BARBARA J. PARKER
