ORDINANCE AMENDING OAKLAND MUNICIPAL CODE CHAPTER 12.12 TO
ALLOW MICROTRENCHING FOR THE INSTALLATION OF
TELECOMMUNICATIONS FIBER AND DIRECTING THE DEPARTMENT O F TRANSPORTATION, WITHIN 90 DAYS OF PASSAGE OF THIS ORDINA NCE,
TO AMEND DEPARTMENT RULES AND ORDERS TO CONFORM WITH THE
ORDINANCE
This ordinance would amend the Oakland Municipal Code to allow microtrenchingfortheinstallationoftelecommunicatio nsfiberanddi- rect the Department of Transportation, within 90 days of passage, to amend department rules and orders to conform with the ordinance.
Microtrenching is an excavation technique that creates a narrow trench—no more than 4 inches wide and between 12 and26 inches deep—fortheinstallationofundergroundfacilities,includingfiberoptic cable for high-speedinternetservice. Historically,microtrenchinghas notbeenpermittedintheCityofOakland.However, CaliforniaSenate Bill 378, passed in October 2021, mandates that alllocal jurisdictions mustamendpolicies,ordinances,codes,orconstruction rulestoallow microtrenching for the installation of telecommunications fiber. Upon finaladoptiononsecondreadingthisordinancewill becomeeffective immediately if it receives six or more affirmative votes; otherwise, it shallbecomeeffectiveupontheseventhdayafterfinaladoption Notice of Publication
