OnMay28,2024,theCommitteeforCommunityandEconomicDevelopment(CEDCommittee) unanimouslyvotedtosendaproposedamendmenttoSection5.80.025oftheOaklandMunicipalCode (O.M.C.)totheJune4,2024OaklandCityCouncilmeeting.Theproposedamendmentoriginatedfrom theAt-LargeOffice.ThissupplementalreportaddressesoutstandingquestionsraisedbytheCED Committeeregardingexistingcannabisordinancesthatarenotchangedbyadoptingtheproposed amendment.Thefollowingbulletedlistaddressesthosequestions. ● OaklandMunicipalCode(OMC)5.80.035 1requirestheCityAdministratortoadoptregulationsforthe permittingofdispensariesandonsiteconsumption. OMC5.80.035furtherrequirescannabispermitteesto remainincompliancewiththeCity'scannabisregulations,OMC5.80,andstatelaw. ● Inaddition, OMC5.80.025(C) 2providestheCityAdministratorwiththeauthoritytoestablishconditionsof approvalforeachonsiteconsumptionpermit,including,butnotlimitedto,aparkingplan,ventilationplan, anti-druggeddrivingplan,andsethoursofoperation.
● SmokingintheCityisregulatedby theCity'ssmokingordinance,OMC8.30 3,which,unlessanduntilitis amended,prohibitssmokinginenclosedplacesofemployment.
