RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE CLAIM OF BCAL
LUP HARRISON PROPERTY LLC, CITY ATTORNEY FILE NO. C36610,
IN THE AMOUNT OF ONE HUNDRED NINETY-EIGHT THOUSAND
FOUR HUNDRED EIGHTEEN DOLLARS AND EIGHT CENTS
($198,418.08) (DEPARTMENT OF PUBLIC WORKS – FAILED SEWER MAIN)
WHEREAS, BCAL LUP Harrison Property LLC (“Claimant”) alleges that on September 13, 2023, a blockage in the City’s sewer main caused damage to Claimant’s property; and
WHEREAS, Claimant submitted the above-entitled claim seeking compensation for said damages; and
WHEREAS, the City of Oakland has determined that settlement in the amount of One Hundred Ninety-Eight Thousand Four Hundred Eighteen Dollars and EIGHT Cents ($198,418.08), without an admission of liability, is in the best interest of the City; now, therefore, be it RESOLVED: That the City Attorney is authorized and directed to compromise and settle the claim of BCAL LUP Harrison Property LLC, City Attorney’s File No. C36610, for the sum of One Hundred Ninety-Eight Thousand Four Hundred Eighteen Dollars and EIGHT Cents ($198,418.08); and be it
FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps may be necessary to effect said settlement.
