President Pro Tempore Gallo and Members of the City Council:
Pursuant to Section 401 of the Charter, the C ity Attorney has prepared and requests your approval of a resolution authorizing compromise a nd settlement of the above-entitled lawsuit for the sum of Three Hundred Thousand Dollars and No Cents ($300,000.00).
Goldmacher alleges that on October 8, 2022, Goldmacher tripped and fell on a sidewalk uplift on Lakeshore Avenue approaching the intersection with Prince Street. Goldmacher alleges the sidewalk uplift was caused by the roots of an official City tree. Gold macher alleges that the uplift was a dangerous condition of public propert y, and that she suffered injuries in the fall, including a broken wrist that required two surgerie s, a torn shoulder tendon, and carpal tunnel syndrome.
The City has determined that settlement in the amount of Three Hundred Thousand Dollars and No Cents ($300,000.00) without admitting liability a nd to avoid further litigation, is in the best interest of the City.
The City Council authorized settlement of this case in Closed Session on Thursday, February 20, 2025 (moved by Councilmember Carroll Fife and seconded by Councilmember Ken Houston - 6 Ayes, 2 Absent – Councilmember Janani Ramachandran and Council President Kevin Jenkins (serving as Mayor pursuant to Charter Section 303).
