APPROVED AS TO FORM AND LEGALITY ___________________________ CITY ATTORNEY’S OFFICE OAKLAND CITY COUNCIL RESOLUTION NO. ______________ C.M.S. RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO EXTEND THE PROFESSIONAL SERVICES AGREEMENT CONTRACT END DATE WITH OCCUPATIONAL HEALTH CENTERS OF CALIFORNIA, A MEDICAL CORPORATION, DBA CONCENTRA MEDICAL CENTERS, TO PROVIDE OCCUPATIONAL MEDICAL SERVICES FOR THE PERIOD OF JULY 1, 2025, TO JUNE 30, 2030. WHEREAS,the City is required by applicable law and regulations to provide occupational medical services and workers’ compensation medical services to City employees; and WHEREAS,the City has determined that it is advisable to obtain these services at the most cost-effective rate; and WHEREAS,the City prepared and distributed a request for proposal to obtain the best overall qualified firm to provide Occupational Medical Services for the City; and WHEREAS, the City conducted a competitive selection process pursuant to section 2.04.051A of the Oakland Municipal Code (Purchasing Ordinance) and only one (1) firm responded to the request for proposal and subsequently met minimum qualifications and participated throughout the review process; andWHEREAS, the City determined that Concentra Health Services has demonstrated its ability to provide efficient, effective, and qualified Occupational Medical Services; andWHEREAS,on April 1, 2018, the City entered into a contract agreement with Concentra through October 31, 2018, for a contract amount of $250,000; andWHEREAS,on October 30, 2018, Council authorized the City Administrator to negotiate and execute an agreement with Concentra Health Services for the provision of occupational medical services for a contract amount not to exceed $600,000 for contract year 2018-2019, and with acceptable performance, options to extend the agreement for three additional two-year terms for a total not to exceed $600,000 per contract year for contract years 2019-2021, 2021-2023 and 2023-2025 for a total not to exceed $4,200,000; andWHEREAS,on October 31, 2018, the City entered into a one-year contract amendment with Concentra for a contract amount of $350,000; and 2 WHEREAS,on July 1, 2019, the City amended the contract agreement with Concentra for an additional two years adding an additional $1,200,000 in funding; and WHEREAS,on July 1, 2021, the City amended the contract agreement with Concentra for an additional two years adding an additional $1,200,000 in funding; and WHEREAS,on June 30, 2023, the City amended the contract agreement with Concentra for an additional two years adding an additional 1,200,000 in funding; and WHEREAS,the City Council finds that this contract is for services of a professional and temporary nature, and shall not result in the loss of employment or salary by any persons having permanent status in the competitive service; now, therefore, be it RESOLVED: That a contract extension is awarded to Occupational Health Centers of California, A Medical Corporation, DBA Concentra Medical Centers, to continue providing Occupational Medical Services for an additional five years, extending the contract through the period of July 1, 2025, through June 30, 2030, while maintaining the original contract amount of $4,200,000; and be it FURTHER RESOLVED: That funding for these services is contained in the associated fiscal year’s Proposed Budget in the Workers’ Compensation Insurance Claims Fund (1150), Risk Management Org (05621), Administrative Project (1000005), Medical and Veterinarian Services (54311), Financial Management Program (IP59); and be it FURTHER RESOLVED: That the City Administrator is authorized to complete all negotiations and execute all contracts, amendments, modifications, and extensions consistent with this resolution and its basic purposes and be it; IN COUNCIL, OAKLAND, CALIFORNIA, PASSED BY THE FOLLOWING VOTE: AYES - BROWN, FIFE, HOUSTON, KAPLAN, RAMACHANDRAN, UNGER, AND PRESIDENT PRO TEMPORE GALLO NOES – ABSENT – COUNCIL PRESIDENT JENKINS (serving as Mayor pursuant to Charter Section 303) ABSTENTION – ATTEST: ASHA REED City Clerk and Clerk of the Council of the City of Oakland, California OCA DOCUMENT NUMBER / ATTORNEY INITIALS – Updated 1/6/2025
