President Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the C ity Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled lawsuit for the sum of One Hundred Twenty-Five and Zero Cents ($125,000.00), payable to George Segura.
This action arises out of Plaintiff George Segura’s claim that on May 11, 2023, Segura rode Segura’s electric scooter on 40
th Street when the scooter’s wheel encountered a sunken utility cover, causing Segura to fall and suffer a fra ctured collarbone and elbow. Segura alleges the sunken utility cover was a dangerous condition of public property of which the City had notice, and claims past and future medical expenses, lost wages, and pain and suffering. The City has determined that settlement in the amount of $125,000.00 to Segura without admitting liability and to avoid further litigation, is in the best interest of the City.
The City Council authorized settlement of th is case in Closed Session on Thursday, October 23, 2025 (moved by President Pro Tem Noel Gallo and seconded by Councilmember Ken Houston - 5 Ayes, 3 Excused – Councilmembers Rowena Brown, Carroll Fife and Janani Ramachandran).
