Utilization of these contracts is contingent upon the availability of Council-authorized appropriations and a funding availability analysis conducted by the Budget Office at the time of standard purchase order request submission or prior to fund encumbrance; and WHEREAS, there is no minimum commitment to the proposed contracts, funds will not be committed beforehand unless funding is identified, and the contractors will have the right to accept or reject any proposed contract extension; and WHEREAS, the City Council finds that to the extent that these agreements are for services of a professional, scientific, or technical nature, the services under the contracts are temporary in duration and shall not result in the loss of employment or salary by any person having permanent status in the competitive services; and WHEREAS, staff recommends that the city council adopt a resolution approving ongoing cooperative purchase agreements exceeding $250,000 for Public Works department’s Maintenance and Internal Services Bureau (Equipment Services Division) commodities and services contracts as set forth in Table 1 in an additional amount not to exceed six million three hundred and ten thousand dollars ($6,310,000) and extend some contract dates as listed; and adopting appropriate California Environmental Quality Act (CEQA) findings; now, therefore, be it RESOLVED: That the City Council approves and, to the extent necessary, awards the ongoing cooperative purchase agreements exceeding $250,000 for commodities and services set forth in Table 1, for an amount not to exceed those amounts listed in Table 1, pursuant to OMC § 2.04.030(a); and be it FURTHER RESOLVED: That the City Council finds that this action is not a project under CEQA Guidelines Section 15060(c)(2) because it will not result in a direct or reasonably foreseeable indirect physical change in the environment; and/or is exempt from CEQA under the common sense exemption (Section 15061(b)(3)); and, independently, to the extent the action results in routine operation, maintenance, or minor alteration of existing facilities or equipment, it is exempt under Section 15301.
