President Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the C ity Attorney has prepared and requests your approval of a resolution authorizing compromise a nd settlement of the above-entitled lawsuit for the sum of Four Hundred Fifty Thousand Dollars and No Cents ($450,000.00).
On May 21, 2024, Plaintiff Robert Solomon stru ck a pothole and crashed while bicycling on Grizzly Peak Boulevard, approximately 1.1 mile south of the intersection with Golf Course Drive and Centennial Drive. Solomon claims that the pothole was a dangerous condition of public property.
Solomon alleges personal injuries related to the accident including a fractured skull, a concussion, a broken nose, fractured vertebrae, ligament sprains and tears, two broken teeth, and an exacerbation of prior mental conditions.
The City has determined that settlemen t in the amount of Four Hundred Fifty Thousand Dollars and No Cents ($450,000.00), without admitting liability and to avoid further litigation, is in the best interest of the City.
The City Council authorized settlement of this case in Closed Session on Thursday, February 19, 2026 (moved by Councilmember Janani Ramachandran and seconded by Councilmember Zac Unger - 6 Ayes, 2 Excused – Council President Kevin Jenkins and Councilmember Ken Houston).
