President Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled lawsuit for the sum of Fifty-Five Thousand Dollars and Zero Cents ($55,000.00).
Plaintiff Madisyn Clark alleges that on April 29, 2023, Clark fell off a motorized scooter while riding down Embarcadero West between Clay and Jefferson Streets and suffered injury.
Clark attributes the fall to a defect in the roadway. Clark alleges that the City had notice of the dangerous condition and seeks to recover for past and future medical expenses, lost wages, and pain and suffering.
The City Council has determined that settlement in the amount of $55,000.00, without admitting liability and to avoid further litigation, is in the best interest of the City.
The City Council authorized settlement of this case in Closed Session on Thursday, April 30, 2026 (moved by Councilmember Carroll Fife and seconded by Councilmember Noel Gallo - 8 Ayes).
