RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO COMPROMISE AND SETTLE THE CLAIM OF BCAL
LMP HARRISON PROPERTY LLC, CITY ATTORNEY FILE NO. C37884,
IN THE AMOUNT OF SIXTY-ONE THOUSAND FIVE HUNDRED FORTY- TWO DOLLARS AND 72/100 CENTS ($61,542.72) (DEPARTMENT OF PUBLIC WORKS – FAILED SEWER MAIN)
WHEREAS, BCAL LMP Harrison Property LLC (“BCAL”) alleges that on May 4, 2025, a blockage in the City’s sewer main caused sewage damage to BCAL’s property located at 1999 Harrison Street; and
WHEREAS, BCAL submitted the above-entitled claim seeking compensation for those damages; and
WHEREAS, the City of Oakland has determined that settlement in the amount of Sixty- One Thousand Five Hundred Forty-Two Dollars and 72/100 Cents ($61,542.72), without an admission of liability, is in the best interest of the City; now, therefore, be it RESOLVED: That the City Attorney is authorized and directed to compromise and settle the claim of BCAL LMP Harrison Property LLC, City Attorney’s File No. C37884, for the sum of Sixty-One Thousand Five Hundred Forty-Two Dollars and 72/100 Cents ($61,542.72); and be it FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps may be necessary to effect said settlement.
