President Kevin Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the C ity Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled claim for the sum of Sixty-One Thousand Five Hundred Forty-Two Dollars and Seventy-Two Cents ($61,542.72), payable to BCAL LMP Harrison Property LLC (“BCAL”).
BCAL alleges that on May 4, 2025, a City sewer main became clogged by grease and debris causing raw sewage to back up on the ground floor of the 27-story Lake Merritt Plaza building located at 1999 Harrison Street. The building’s owner, BCAL, seeks $61,542.72 in damages.
The City of Oakland has determined that sett lement in this amount, without an admission of liability, is in the best interest of the City.
The Council authorized settlement of this cas e in Closed Session on Thursday, May 21, 2026 (moved by Councilmember Noel Gallo and seconded by Councilmember Rowena Brown - 8 Ayes).
