ATTORNEY TO SETTLE THE CASE OF RAVEN LUQUE V. CITY OF
OAKLAND, STATE OF CALIFORNIA AND DOES 1 THROUGH 100,
INCLUSIVE, ALAMEDA COUNTY SUPERIOR COURT CASE NO.
24CV081174, CITY ATTORNEY FILE NO. 36783, BY PAYMENT IN THE
AMOUNT OF ONE HUNDRED SIXTY THOUSAND DOLLARS AND
ZERO CENTS ($160,000.00) (DEPARTMENT OF TRANSPORTATION -
DANGEROUS CONDITION)
WHEREAS, Plaintiff Raven Luque alleges that on August 8, 2023, they sustained physical injury as a result of a fall due to cracks and depressions on West MacArthur Boulevard; and WHEREAS, Luque filed suit entitled Raven Luque v. City of Oakland, State of California, and DOES 1-100, Alameda County Superior Court Case No. 24CV081174, alleging a cause of action against the City for dangerous condition of public property; and WHEREAS, without admitting fault or wrongdoing, the City has determined to compromise Luque's claims for the sum of One Hundred and Sixty Thousand Dollars and Zero Cents ($160,000.00); now, therefore, be it
RESOLVED: That the City Attorney is authorized and directed to compromise and settle the case of Raven Luque v. City of Oakland, State of California, and DOES 1-100, Alameda County Superior Court Case No. 24CV081174 for the sum of One Hundred Sixty Thousand Dollars and Zero Cents ($160,000.00); and be it
FURTHER RESOLVED: That the City Attorney is further authorized and directed to take whatever steps as may be necessary to effect said settlement.
