President Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled lawsuit for the sum of One Hundred Sixty Thousand Dollars and Zero Cents ($160,000.00).
On August 8, 2023, at approximately 4:00 p.m., Plaintiff Raven Luque rode a motor scooter westbound on West MacArthur Boulevard near Pied mont Avenue and struc k large cracks and depressions in the road. The impact allegedly caused Luque to lose control of the scooter and fall.
Luque alleges injuries including a fractured right ankle, and claims past and future medical expenses, lost wages, and genera l damages for pain and suffering. The City has determined that settlement in the amount of $160,000.00, without admitting liability and to avoid further litigation, is in the best interest of the City.
The Council authorized settlement of this case in Closed Session on Thursday, June 4, 2026 (moved by Councilmember Zac Unger and seconded by Councilmember Noel Gallo - 8 Ayes).
