and WHEREAS, routine and emergency collision repair and body shop services are necessary to ensure that City vehicles are maintained in safe operating condition and returned to service in a timely manner; and WHEREAS, the Oakland Public Works Department, Equipment Services Division, currently faces staffing shortages that limit its internal capacity to perform specialized collision repair services; and WHEREAS, the City issued Request for Qualifications (RFQ) No. 406535 for light vehicle services and RFQ No. 406529 for heavy vehicle services in accordance with the Oakland Municipal Code and purchasing policies; and WHEREAS, collision repair and body shop services for City vehicles are specialized, as-needed services requiring specialized facilities, tools, equipment, trained personnel, towing or pick-up capability, regulatory compliance, and the ability to perform repair-specific work on light- and heavy-duty vehicles; and WHEREAS, the City Council finds and determines that strict formal bidding and award to a single lowest bidder would be impracticable, unavailing, and not in the City’s best interests because the City requires multiple qualified contractors to provide adequate capacity, timely turnaround, operational redundancy, and continuity of critical fleet services; and WHEREAS, to the extent required by OMC section 2.04.050, the City Council finds and determines that the services are specialized services, that further formal advertising and bidding should be waived, and that the recommended multi-award approach is in the best interests of the City; and WHEREAS, the City conducted a competitive RFQ process consistent with OMC section 2.04.051, and the recommended awards are based on demonstrated competence, qualifications, responsiveness, experience, pricing, capacity, and fair and reasonable prices to the City; and 3 WHEREAS, the City Council finds that awarding multiple as-needed contracts will protect the City by preserving competition, improving service capacity, reducing repair turnaround time, avoiding over-reliance on a single vendor, and allowing work assignments based on operational need, vendor availability, pricing, performance, and overall best value to the City; and WHEREAS, the RFQ process was conducted competitively and vendors were evaluated based on qualifications, experience, cost competitiveness, and responsiveness; and WHEREAS,the recommended vendors were determined to be the most qualified and responsive to meet the City’s operational needs; and WHEREAS,establishing multiple contracts will improve service capacity, reduce repair turnaround times, and provide operational flexibility compared to a single-vendor model; andWHEREAS,funding for these contracts is available in the Equipment Fund (4100), Equipment Services Administration Organization (30541), DP300 Administrative Project (1000010), and Fleet Management & Maintenance Program (IN01), and expenditures are contingent upon the availability of appropriated funds; and WHEREAS,this action is not a “project” under CEQA pursuant to CEQA Guidelines section 15378(b)(5) because it is an administrative and fiscal activity that will not result in a direct or foreseeable indirect physical change in the environment; and, alternatively, the action is exempt under CEQA Guidelines sections 15061(b)(3) and 15301 because it involves repair and maintenance of existing City-owned vehicles and mechanical equipment with negligible or no expansion of use, and none of the exceptions in CEQA Guidelines section 15300.2 apply now, therefore, be it RESOLVED: That the City Council hereby authorizes the City Administrator to award contracts to the vendors and in the amounts identified above for collision repair and body shop services for light- and heavy-duty vehicles; and be it FURTHER RESOLVED: That the City Council finds and determines that the requirements of OMC sections 2.04.050 and 2.04.051 have been satisfied or, to the extent necessary, that any further formal advertising and bidding requirements are waived under OMC section 2.04.050 because the services are specialized, strict formal bidding would be impracticable and unavailing for these as-needed multi-award services, and the recommended awards are in the best interests of the City; and be it 4 FURTHER RESOLVED: That each contract shall be for a three-year term from September 1, 2026, through September 1, 2029, with two one-year options to renew at the discretion of the City Administrator; and be it FURTHER RESOLVED: There is no minimum commitment to any awarded contract; funds will not be committed unless funding is identified, and the contractor will have the right to accept or reject any proposed contract extension; and be it FURTHER RESOLVED: That the City Administrator is authorized to execute any amendments, extensions, or related actions within the authorized contract amounts and terms, consistent with this Resolution; and be it FURTHER RESOLVED: That the City Council independently finds and determines that this action is not a project under CEQA Guidelines section 15378(b)(5); and, alternatively, is exempt under CEQA Guidelines sections 15061(b)(3) and 15301, with no applicable exception under CEQA Guidelines section 15300.2; and be it FURTHER RESOLVED: That all contracts shall be reviewed and approved as to form and legality by the Office of the City Attorney and filed with the Office of the City Clerk.
