HONORABLE CITY COUNCIL
Oakland, California
Subject: Ray Mueller v. City of Oakland
Case No. 25CV125388
City Attorney File No. 37431
(Oakland Department of Transportation – Dangerous Condition) President Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the C ity Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled lawsuit for the sum of Forty-Five Thousand Dollars and Zero Cents ($45,000.00).
This action arises from Plaintiff Ray Mueller’s claim that on June 7, 2024, Mueller fell off a bicycle while riding over a pothole on Montclair Avenue near Park Boulevard. Mueller allegedly suffered a head injury and road rash. Mueller seeks recovery for medical bills, lost wages, and pain and suffering.
The City has determined that settlement in the amount of $45,000.00, without admitting liability and to avoid further litigation, is in the best interest of the City.
The Council authorized settlement of this case in Closed Session on Thursday, July 9, 2026 (moved by Councilmember Charlene Wang and seconded by Councilmember Zac Unger - 5 Ayes, 3 Excused – Councilmembers Carroll Fife, Ken Houston and Janani Ramachandran).
Respectfully submitted,
RYAN RICHARDSON
City Attorney
