bikeway will provide a continuous north-south bicycle connection between Oakland and Berkeley and implement recommendations from the City's adopted bicycle plan, Let's Bike Oakland (2019). Overall, these improvements are designed to slow traffic on MLK Jr. Way, improve visibility and safety for people crossing the street, and provide a separated bike lane.
Approval of the proposed resolution will also authorize the City Administrator to adopt appropriate California Environmental Quality Act (CEQA) findings.
BACKGROUND / LEGISLATIVE HISTORY
On December 21, 2021, the City Council adopted Resolution No. 88975 C.M.S., establishing the 2022 5-Year Paving Plan (5YP), a more than 300 million dollar plan for the Oakland Department of Transportation (OakDOT) to repair City of Oakland (City) streets. The 5YP established a framework for prioritizing street rehabilitation projects based on pavement condition, equity, traffic safety, and multimodal transportation needs. The Project segment of Martin Luther King Jr. Way was prioritized in the 5YP for preventative maintenance treatment to preserve pavement quality.
The Project scope was developed to address roadway resurfacing needs while integrating complete streets improvements and ADA upgrades. Planned improvements include:
• Rubberized Asphalt Preventive maintenance
• Base repair and utility adjustment work
• Installation and retrofit of pedestrian curb ramps
• Transit boarding islands and reinforced concrete bus pad improvements • Lane reduction from 3 lanes in each direction to 2, keeping left-turn lanes where necessary
• Separated bike lanes
• 4 new pedestrian hybrid beacons at unsignalized crosswalk locations • Curb and gutter reconstruction
• Traffic striping and pavement marking improvements
• Drainage and channel drain improvements; and
• Traffic safety and operational improvements
In addition to the roadway resurfacing, the Project implements recommendations established in the Let's Bike Oakland, the citywide bicycle plan adopted by City Council through Resolution No. 87808 C.M.S. on June 25, 2019. Let’s Bike Oakland identified Martin Luther King Jr. Way as a priority north-south bicycle corridor and recommended separated bicycle facilities to improve safety, connectivity, and access for people bicycling between Oakland and Berkeley.
These improvements are consistent with the goals of Oakland’s Measure U program to preserve and rehab existing infrastructure while improving safety, accessibility, and mobility for all roadway users.
ANALYSIS AND POLICY ALTERNATIVES
On May 7, 2026, the Office of the City Clerk received bids for the Martin Luther King Jr. Way Complete Streets Resurfacing Project, from McGuire and Hester and Redgwick Construction Elizabeth A. Lake, Interim City Administrator

Co. The Engineer's Estimate for the Project was $7,157,100.00. McGuire and Hester submitted a bid of $7,306,798.13 and Redgwick Construction Co. submitted a bid of $8,224,989.63.
Following bid opening, Redgwick Construction Co. submitted a bid protest alleging that McGuire and Hester's bid was non-responsive. OakDOT, Oakland Public Works, the Department of Workplace and Employment Standards (DWES), and the Office of the City Attorney reviewed the protest, bid documents, subcontractor information, and supporting materials and determined that the protest did not provide sufficient grounds to reject McGuire and Hester's bid as nonresponsive.
DWES reviewed the bids submitted for the Project and determined that both bidders met the Project's Local and Small Local Business Enterprise (L/SLBE) participation requirements (Attachment A). The L/SLBE participation requirement for this Project was established at 36%, consisting of 18% Local Business Enterprise (LBE) participation and 18% Small Local Business Enterprise (SLBE) participation.
McGuire and Hester, a certified Local Business Enterprise (LBE), exceeded the minimum participation requirements and received a four percent bid discount based on the combination of participation beyond the required minimum and its approved Mentor-Protégé Agreement with a certified Very Small Local Business Enterprise (SLBE).
Redgwick Construction Co., also a certified LBE, exceeded the minimum participation requirements and received a ten percent bid discount based on the combination of participation beyond the required minimum and its approved Mentor-Protégé Agreement with a certified Very Small Local Business Enterprise (VSLBE).
Pursuant to the City's L/SLBE Program requirements, DWES determined both bids to be responsive and eligible for their respective earned bid discounts. The City's Bid and Proposal Review Summary confirmed that both firms were responsive to the Project's L/SLBE requirements. Following application of the earned bid discounts, McGuire and Hester remained the lowest responsive and responsible bidder as shown in Table 1.
Table 1: Bid Results and L/SLBE Bid Discounts
BIDDER BID AMOUNT BID DISCOUNT ADJUSTED BID
MCGUIRE AND HESTER $7,306,798.13 4.00% $7,014,526.20
REDGWICK CONSTRUCTION CO. $8,224,989.63 10.00% $7,402,490.67 Staff recommends award of the construction contract to McGuire and Hester as the lowest responsive and responsible bidder. The contractor is registered with the California Department of Industrial Relations (DIR) and possesses the required contractor licenses. Approval of this resolution will allow the City to proceed with pavement management and complete streets improvements that will improve roadway conditions, accessibility, transit infrastructure, and safety for all corridor users. Delaying approval of the contract award would postpone implementation of roadway resurfacing and accessibility improvements, increase future maintenance costs, and delay traffic safety improvements along the corridor.

RELATED PLANNING EFFORTS
Equitable Climate Action Plan
The Project advances the City's Equitable Climate Action Plan by improving infrastructure that supports walking, transit, and other low-carbon transportation modes. ADA curb ramp improvements, sidewalk reconstruction, transit boarding enhancements, and complete streets improvements help create safer and more accessible multimodal transportation options while reducing barriers to non-automobile travel.
In addition, pavement rehabilitation and complete streets improvements support equitable transportation investments in communities that have historically experienced infrastructure deficiencies. The Project aligns with ECAP transportation and land use actions that seek to improve mobility options, reduce transportation-related greenhouse gas emissions, and provide equitable access to safe transportation infrastructure.
Economic Development Action Plan
The Project supports Oakland's Economic Development Action Plan by preserving and improving transportation infrastructure serving residential neighborhoods, commercial corridors, transit services, and local businesses. Reliable transportation infrastructure improves mobility, goods movement, and access to employment centers while supporting economic activity along the corridor.
The Project also supports local workforce and business development objectives through the City's L/SLBE Program requirements, which create contracting opportunities for Oakland-based businesses, including certified local, small local, and very small local firms. Project construction activities will generate economic benefits through direct construction employment and utilization of local contractors and suppliers.
Let’s Bike Oakland (Oakland Bike Plan)
Let’s Bike Oakland, the Oakland Bike Plan, adopted in on June 25, 2019, recommended separated bike lanes on MLK Jr. Way between 47th Street and the Berkeley border. This Project implements this recommendation.

PUBLIC OUTREACH / INTEREST
OakDOT coordinated with internal City departments and utility agencies during development of the Project plans and specifications. The Project supports ongoing Citywide efforts to improve roadway safety, pavement conditions, pedestrian accessibility, and transit infrastructure.
OakDOT conducted extensive community engagement and outreach for this project in 2021 and 2022, hosting multiple community site walks and public events, providing presentations to City Boards and Commissions and local Neighborhood Councils, hosting small-group stakeholder meetings with local businesses, and conducting several meetings with UCSF Benioff Children’s Hospital. OakDOT sent out 2,500 postcards to the local neighborhood and received 631 responses to a project survey with demographics of the survey respondents found to be representative of those in the surrounding community. OakDOT also coordinated closely with AC Transit on notification and outreach to transit riders, posting information on buses that run on MLK Jr. Way, conducting intercept surveys at transit stops, and working with organizations that represent transit riders.
Contractor notifications were conducted through the City’s standard competitive bidding process. The solicitation was advertised through the City’s iSupplier system, the City’s Bids/Contracts webpage, and applicable trade publications Construction notification and coordination with residents, businesses, transit agencies, and other stakeholders will occur prior to and during construction activities.
COORDINATION
This report and legislation have been coordinated with DWES. This report and the resolution have been reviewed by the Office of the City Attorney and the Budget Bureau of the Finance Department.
RACE AND EQUITY
The Project advances the City’s goals related to equitable investment in transportation infrastructure, improved accessibility, and safer travel options for historically underserved communities. ADA curb ramp, transit boarding island improvements, and sidewalk improvements will improve accessibility for persons with disabilities and mobility-impaired users.
All project outreach materials were translated in Spanish, Chinese, and Amharic based on languages prevalent in the project area. The separated bike lane and road diet components of this project were proposed by the 2019 Let’s Bike Oakland Bike Plan, a document grounded in Citywide equitable outreach related to transportation infrastructure. This project will remove a lane in each direction from MLK Jr Way, a street that was widened as part of BART construction in the 1960s, and which today represents a barrier to access between neighborhoods, with multiple uncontrolled pedestrian crossings of a 6 to 8 lane roadway. This project will work to address those past inequitable planning decisions by narrowing the roadway, slowing speeds, and installing 4 Pedestrian Hybrid Beacons to stitch back together neighborhoods separated by Elizabeth A.
