Case No. 24CV080638
City Attorney File No. CE05481
(Office of the City Attorney – Unpaid Restitution)
President Jenkins and Members of the City Council:
Pursuant to Section 401 of the Charter, the City Attorney has prepared and requests your approval of a resolution authorizing compromise and settlement of the above-entitled lawsuit for the sum of Six Hundred Thousand Dollars and Zero Cents ($600,000.00).
This case arose out of employees of the Radisson hotel formerly located at 8400 Edes Avenue (the “Radisson”) filing claims with the City’s Department of Workplace and Employment Standards (“DWES”), alleging that the Radisson violated the minimum wage provisions of the Hotel Minimum Wage Ordinance. Following an investigation, DWES determined the Radisson failed to pay the correct minimum wage to 128 former employees and issued a Notice of Determination stating that the Radisson owed $404,491 in back wages. The City filed a Complaint asserting a cause of action of unpaid restitution to 128 former employees of the Radisson.
Under the proposed settlement agreement, Nupenbhai Patel agrees to pay Five Hundred and Eleven Thousand and Six Hundred and Eighty-Five Dollars and Zero Cents ($511,685.00) to the 128 former employees, representing Four Hundred and Four Thousand and Four Hundred and Ninety-One Dollars and Zero Cents ($404,491.00) in restitution and One Hundred and Seven Thousand and One Hundred and Ninety-Four Dollars and Zero Cents ($107,194.00) in interest, and Eighty-Eight Thousand and Three Hundred and Fifteen Dollars and Zero Cents ($88,315.00) to the City in attorneys’ fees.
