WHEREAS, the City of Oakland ("City") is committed to building a diverse, skilled, and representative workforce that reflects the communities it serves, and recognizes that cultivating local talent from within Oakland's own neighborhoods is essential to the long-term strength, sustainability, and vitality of City operations; and
WHEREAS, City departments regularly encounter workforce pipeline challenges, including the need to develop early talent, build succession capacity, and ensure that Oakland residents particularly young people from historically underserved communities have meaningful access to public sector career pathways and professional development opportunities; and WHEREAS, the City currently engages in various workforce development and youth employment initiatives, but lacks a standardized, citywide framework for hosting student interns from the Oakland Unified School District ("OUSD") in a manner that is consistent, legally sound, and scalable across departments; and
WHEREAS, hosting OUSD student interns through a structured Work Training Partner Program directly benefits City departments by providing access to motivated local youth who bring fresh perspectives, community connections, and emerging skills to City operations, while simultaneously strengthening the City's relationship with the communities it serves and contributing to Oakland's broader economic mobility and workforce development goals; and 2 WHEREAS, partnering with OUSD through a formal Memorandum of Understanding is essential to ensuring that City departments host student interns within a clear, legally compliant framework that defines roles and responsibilities, protects student welfare, maintains data privacy, and upholds all applicable state and federal requirements, including work permit compliance under California Education Code section 49110, FERPA obligations, and criminal background check requirements; and
WHEREAS, the OUSD Work Training Partner Program offers a structured and proven mechanism through which City departments may engage student interns during the applicable summer program period under the terms of the OUSD Work Training Commitment, with OUSD administering program logistics, intern placement, and compliance oversight at no cost to the City; and
WHEREAS, OUSD has demonstrated the capacity and experience to administer a broad, public private partnership internship program that places students in professional environments, and provides interns and host organizations with structured workplace learning frameworks aligned with workforce readiness goals; and
WHEREAS, participation in the Work Training Partner Program is offered at no cost to the City; OUSD retains sole discretion to provide stipends to student interns at amounts determined by OUSD; and
WHEREAS, the internship activities to be performed by OUSD students under this Agreement are educational, supplemental, and temporary in nature and will not result in the displacement or reduction of any City employee holding permanent civil service status; now, therefore, be it
RESOLVED: That the City Council hereby authorizes the City Administrator, or designee, to enter into a Memorandum of Understanding (MOU) with the Oakland Unified School District to establish a framework for City of Oakland departments to host OUSD student interns through the Work Training Partner Program, for a three-year term from the date of execution, with an option to extend for one additional year, and at no cost to the City, and be it FURTHER RESOLVED: That the City Administrator, or designee, is authorized to approve the placement of OUSD student interns within participating City departments during the applicable summer program periods, and that OUSD may, at its sole discretion, provide stipends to student interns at amounts to be determined by OUSD; and be it FURTHER RESOLVED: That the City Administrator, or designee, is authorized to execute all necessary negotiations, certifications, assurances, and documentation required to accept, modify, extend, or amend the MOU, provided that no amendment resulting in an expenditure shall occur without further Council approval; and be it 3 FURTHER RESOLVED: That the City Attorney shall review and approve the final MOU as to form and legality, and a fully executed copy of the agreement shall be placed on file with the Office of the City Clerk.
