6.1 Selection of Mayor and Vice Mayor
a) Overview of Selection Process (Derek Cole, City Attorney) City Attorney Derek Cole provided an overview of the selection process. b) Selection of Mayor and Vice Mayor
An online comment submitted by an Oakley resident was read into the record as requested on the comment.
Councilmember Meadows motioned to nominate Vice Mayor Shaw as Mayor.
City Attorney Derek Cole mentioned that if a selection is made that is contrary to the rotation provided in the Oakley Municipal Code, it must meet one or more of the criteria set forth in section 2.1.003(e).
Councilmember Meadows mentioned criteria 2, 3, and 5 are the basis for his decision.
Councilmember Fuller requested he state the reasons aloud, not only the numbers.
Mr. Cole clarified Councilmember Meadows is nominating Vice Mayor Shaw as Mayor based on criteria 2, 3 and 5.
The motion was seconded by Councilmember Williams. AYES: Henderson, Meadows, Shaw, Williams. NOES: Fuller. (4-1)
Mr. Cole mentioned the code section they are referring to is section 2.1.003(f); the appointment of any member that deviates from the default rotation does not reset the rotation for next year; it will be Districts 4 and 3 for the rotation of Mayor and Vice Mayor, so this year’s nomination doesn’t affect the rotation for next year. He mentioned criteria 6 could be construed that the Mayor cannot also have time to be the Vice Mayor.
There were no public comments for the selection of Vice Mayor.
Councilmember Williams nominated Councilmember Henderson as Vice Mayor. She mentioned she is next in line for appointment pursuant to the code, but under criteria 6, she does not have time to be Vice Mayor. The motion was seconded by Mayor Shaw.
AYES: Henderson, Meadows, Shaw, Williams. NOES: Fuller. (4-1)
