BED BUG DISCLOSURE
California Civil Code §1954.603
(C.A.R. Form BBD, Revised 6/23)
The following terms and conditions are hereby incorporated in and made a part of the Residential Lease or Month-to-Month Rental Agreement, OR Residential Lease After Sale, Other (“Agreement”), dated , on property known as
,
in which is referred to as “Tenant”
and is referred to as “Housing Provider”.
INFORMATION ABOUT BED BUGS:
1. Bed Bug Appearance: Bed bugs have six legs. Adult bed bugs have flat bodies about 1/4 of an inch in length. Their color can vary from red and brown to copper colored. Young bed bugs are very small. Their bodies are about 1/16 of an inch in length. They have almost no color. When a bed bug feeds, its body swells, may lengthen, and becomes bright red, sometimes making it appear to be a different insect. Bed bugs do not fly. They can either crawl or be carried from place to place on objects, people, or animals. Bed bugs can be hard to find and identify because they are tiny and try to stay hidden.
2. Life Cycle and Reproduction: An average bed bug lives for about 10 months. Female bed bugs lay one to five eggs per day. Bed bugs grow to full adulthood in about 21 days.
3. Bed bugs can survive for months without feeding.
4. Bed Bug Bites: Because bed bugs usually feed at night, most people are bitten in their sleep and do not realize they were bitten.
A person's reaction to insect bites is an immune response and so varies from person to person. Sometimes the red welts caused by the bites will not be noticed until many days after a person was bitten, if at all.
5. Common signs and symptoms of a possible bed bug infestation:
● Small red to reddish brown fecal spots on mattresses, box springs, bed frames, mattresses, linens, upholstery, or walls. ● Molted bed bug skins, white, sticky eggs, or empty eggshells. ● Very heavily infested areas may have a characteristically sweet odor. ● Red, itchy bite marks, especially on the legs, arms, and other body parts exposed while sleeping. However, some people do not show bed bug lesions on their bodies even though bed bugs may have fed on them.
6. For more information, see the Internet Web sites of the United States Environmental Protection Agency and the National Pest Management Association.
7. Tenant shall report suspected infestations by bed bugs to the Housing Provider or Property Manager at the mailing, or email address or phone number provided in the Agreement and cooperate with any inspection for and treatment of bed bugs.
8. Housing Provider will notify tenants of any units inspected by a pest control operator of the findings by such an operator within 2 business days of the receipt of the findings. All Tenants will be notified of confirmed infestations within common areas.
Tenant agrees to release, indemnify, hold harmless and forever discharge Housing Provider and Housing Provider's employees, agents, successors and assigns from any and all claims, liabilities or causes of action of any kind that Tenant, members of Tenant's household or Tenant's guests or invitees may have at any time against Housing Provider or Housing Provider's agents resulting from the presence of bedbugs due to Tenant's failure to comply with this Bed Bug Disclosure.
The foregoing terms and conditions are hereby agreed to, and the undersigned acknowledge receipt of a copy of this document.

D. Housing providers should not make any statement or advertisement that directly or indirectly implies preference, limitation, or discrimination regarding any protected characteristic (such as “no children” or “English-speakers only”).
E. Housing providers should use a selection process relying on objective information about a prospective buyer's offer or tenant's application and not seek any information that may disclose any protected characteristics (such as using a summary document, e.g. C.A.R. Form SUM-MO, to compare multiple offers on objective terms).

A. Legally compliant senior housing is exempt from FHA, FEHA and Unruh as related to age or familial status only; B. An owner of a single-family residence who resides at the property with one lodger may be exempt from FEHA for rental purposes, PROVIDED no real estate licensee is involved in the rental; C. An owner of a single-family residence may be exempt from FHA for sale or rental purposes, PROVIDED (i) no real estate licensee is involved in the sale or rental and (ii) no discriminatory advertising is used, and (iii) the owner owns no more than three single-family residences. Other restrictions apply; D. An owner of residential property with one to four units who resides at the property, may be exempt from FHA for rental purposes, PROVIDED no real estate licensee is involved in the rental; and E. NOTICE OF CHANGE IN TERMS OF
TENANCY INSTRUCTIONS
THE TENANT PROTECTION ACT OF 2019, aka AB 1482, (“TPA”): The TPA (i) imposed limits on the amount a property owner can increase rent to a residential tenant (“Rent Cap”) and (ii) identified a limited number of reasons that a property owner may terminate a tenancy and evict a tenant (“Just Cause”). Exemptions exist to both the Rent Cap and Just Cause laws.
Common Exemptions: Under the TPA, the most common exemptions from just cause eviction laws are: (1) separately alienable single-family dwellings, including a condominium, as long as the property is not owned by ● a corporation: ● a limited liability company with a corporate member; or ● a real estate investment trust. For this exemption to apply, the Housing Provider must first give the tenant applicable notice of the exemption; (2) dwellings built in the previous 15 years prior to this notice; (3) a duplex in which one of the units was owner occupied at the commencement and throughout the tenancy; (4) single family owner occupied residences in which the owner rents no more than two units or bedrooms, including accessory dwelling units or junior accessory dwelling units; and (5) housing accommodations in which the tenant shares bathroom or kitchen facilities with the owner. Other exemptions may be applicable.
USE OF FORM AND TPA: In paragraph 1, identify if the Property or tenancy is covered by the TPA. If it is, fill out paragraph 2. If Property or tenancy is NOT covered by the TPA, fill out paragraph 3. This form is not intended for use in commercial tenancies and shall not be used if the tenant is a Qualified Commercial Tenant. If property owner is uncertain whether the property or tenancy is exempt from the TPA, property owner is advised to seek legal counsel from a qualified California real estate attorney who is familiar with the TPA.
USE OF FORM OR ALTERNATIVE: Housing Provider is advised to review the existing lease agreement and compare it with the most recent version available. Laws may have changed since the commencement of the lease. Further, the terms of the agreement may have been modified over time. Housing Provider is advised to seek legal counsel from a qualified local landlord tenant attorney about whether it is recommended to try to execute a new lease at this time or incorporate new terms as part of this Notice of Change in Terms of Tenancy.
LOCAL RENT AND EVICTION CONTROL WARNING: If the property where the Premises is located is subject to a city or county rent or eviction control ordinance or any eviction moratorium, or if housing provider does not know if the property is subject to a city or county rent or eviction control ordinance or moratorium, owner/agent is advised to seek legal counsel from a qualified local landlord tenant eviction attorney before serving this Notice.

O (925) 625-7000 | F (925) 625-9859 | www.ci.oakley.ca.us DATE: January 13, 2026
TO: Joshua McMurray, City Manager
FROM: Billilee Saengchalern, P.E., T.E., Public Works Director/City Engineer SUBJECT: Creating Zone 201 within the Oakley Special Police Tax Area consisting of the Sandoval Minor Subdivision (MS 23-977) project located at 115 Malicoat Avenue (APN 033-052-003-2)
Background and Analysis
On June 4, 2024, the City Planning Commission approved a tentative map with certain Conditions of Approval for the proposed Sandoval Minor Subdivision (MS 23-977) project (the “Project”). The Project is designated as Residential Low/Medium in the Oakley General Plan and zoned R-6 (Single-Family Residential) district on the City of Oakley Zoning Map. The Project is currently comprised of APN 033-052-003-2, which is expected to be subdivided into three residential parcels. An existing single-family home will remain on one of the resultant parcels, and no further construction is proposed at this time.
The Conditions of Approval for the Project require the Developer to mitigate the financial impact their project has on the City’s police services budget. The City of Oakley previously formed the Oakley Special Police Tax Area that authorizes the levy of an annual special tax on parcels to mitigate their financial impact to the City’s police services budget. The property owner for the Project has requested the City assist with annexing the Project into the Oakley Special Police Tax Area to satisfy their Conditions of Approval.
Beginning May 2016, the City established its own police department and no longer contracts with the Sheriff’s office to provide public safety. In order to ensure that revenue grows at a rate sufficient to cover the cost of providing police services, City Council approved Resolution No. 113-16 on July 12, 2016, that allows for an adjustment in the annual tax per parcel by the increase in the Consumer Price Index for all Urban Consumers for the San Francisco-Oakland-Bay Area to become effective July 1, 2016.
Adoption of the attached resolution and introduction of the attached ordinance will set an election date for February 16, 2026, which shall be conducted by the City Clerk via a mail ballot election. The vote will then be ratified at the February 24, 2026 regular City Council meeting, and the ordinance will take effect at that time assuming a favorable vote.

O (925) 625-7000 | F (925) 625-9859 | www.ci.oakley.ca.us Consistency with the Oakley Strategic Plan 27+
This item is consistent with the Strategic Plan 27+ Park and Open Space and Finance and Fiscal Responsibility section goals.
Fiscal Impact
There will be no financial impact to the City's General Fund. The applicant has funded all costs associated with the annexation of Zone 201 to the Oakley Special Police Tax Area. The Fiscal Year 2025-26 special tax rate is $1,347.54/parcel for developed single family parcels and $673.77/parcel for vacant single-family parcels. The Project is anticipated to consist of one developed single family residential lots and two vacant single-family lots after the proposed parcel subdivision. Therefore, successful creation of the Zone is expected to provide up to $2,695.08 (in Fiscal Year 2025-26 dollars) in revenue annually at build-out. The taxes can be collected on the property tax rolls commencing in Fiscal Year 2026-27.
Staff Recommendation
The Conditions of Approval for the Sandoval Minor Subdivision (MS 23-977) project located at 115 Malicoat Avenue (APN 033-052-003-2) require the property owner to mitigate their financial impact on the police services budget. Adoption of this resolution and ordinance will set an election to be held on February 16, 2026. The election will then be ratified at the February 24, 2026 regular City Council meeting. Staff recommends that the City Council:
1. Adopt the Resolution creating Zone 201 within the Oakley Special Police Tax Area consisting of the Sandoval Minor Subdivision (MS 23-977) project located at 115 Malicoat Avenue (APN 033-052-003-2); and
2. Introduce the Ordinance Establishing a Special Tax for Police Protection.

Ordinance No. XX-26 Page 1 of 4
ORDINANCE NO. XX-26
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OAKLEY
ESTABLISHING OAKLEY SPECIAL POLICE TAX AREA ZONE 201 WITHIN THE
OAKLEY SPECIAL POLICE TAX AREA FOR A SPECIAL TAX FOR POLICE PROTECTION SERVICES FOR THE SANDOVAL MINOR SUBDIVISION (MS 23- 977) PROJECT LOCATED AT 115 MALICOAT AVENUE (APN 033-052-003-2) The Voters of the City of Oakley do ordain as follows:
Section 1. Purpose, Intent and Authority.
It is the purpose and intent of this Ordinance to authorize the levy of a special tax on real property that is within Oakley Special Police Tax Area Zone 201 of the Oakley Special Police Tax Area as shown on the Exhibit A map attached hereto in order to provide funding for police protection to serve the property and persons within said Zone.
This Tax is a special tax within the meaning of Section 4 of Article XIIlA of the California Constitution. Because the burden of this tax falls upon property, this tax also is a property tax, but this tax is not determined according to nor in any manner based upon the value of property; this tax is levied on a parcel and use of property basis. Insofar as not inconsistent with this Ordinance or with legislation authorizing special taxes and insofar as applicable to a property tax that is not based on value, such provisions of the California Revenue and Taxation Code and of Article XIII of the California Constitution as relate to ad valorem property taxes are intended to apply to the collection and administration of this tax (Section 4 of this Ordinance), as authorized by law.
The revenues raised by this tax are to be used solely for the purposes of obtaining, furnishing, operating, and maintaining police protection equipment or apparatus, for paying the salaries and benefits of police protection personnel, and for such other police protection service expenses as are deemed necessary for the benefit of the residents of Zone 201.
This Ordinance is enacted pursuant to the authority of Government Code Section 53978.
Section 2. Definitions.
The following definitions shall apply throughout this Ordinance.
A. "Constant first year dollars" shall mean an actual dollar amount which, in years subsequent to the first fiscal year the tax is levied, shall have the same purchasing price as the base amount in first fiscal year dollars as measured by the actual cost of services for the City of Oakley's cost of obtaining police services. The base amount shall be the amount of tax per parcel as specified in Section 3.A herein. The adjustments from actual 815
Ordinance No. XX-26 Page 2 of 4
to constant dollars shall be made by use of the actual cost of services, as specified in Section 3.B herein.
B. "Fiscal year" means the period of July 1 through the following June 30.
C. "Oakley Special Police Tax Area" includes all properties within the jurisdictional limits of the City of Oakley.
D. Oakley Special Police Tax Area Zone 201 (hereinafter called "Zone") means that portion of the incorporated area of the City of Oakley located within the boundaries as shown on the map Exhibit A hereto.
E. "Parcel" means the land and any improvements thereon, designated by an assessor's parcel map and parcel number and carried on the secured property tax roll of Contra Costa County. For the purposes of this Ordinance, parcel does not include any land or improvements outside the boundaries of the Zone, nor any land or improvements owned by any governmental entity.
F. Pursuant to Government Code §53978, "voter" means a person owning real property within the Zone at the time this Ordinance was adopted, as shown on the last equalized assessment role prepared by the Contra Costa County Assessor's Office.
Section 3. Amount and Level of Taxes.
The tax per year on each parcel in the Zone shall not exceed the amount applicable to the parcel, as specified below.
A. For First Fiscal Year:
The tax per year for the first fiscal year (July 1, 2025 through June 30, 2026) shall be the amount of Tax Per Parcel for a Property Use Code Category as set forth on Exhibit B hereto. If any new development, including new residential units, is completed prior to the tax being effective for the first fiscal year, the owner of the Parcel, as shown on the latest assessment roll, shall pay the tax for the remainder of such fiscal year on a prorated basis to the City, no later than receipt of Certificate of Occupancy or final building permit inspection.
B. For Subsequent Fiscal Year:
The tax rates shown in Exhibit B shall be automatically adjusted on July 1 of each year, beginning on July 1, 2026 by the increase in the Consumer Price Index for all Urban Consumers for the San Francisco-Oakland Bay Area and applying that rate to the prior year amounts for each property use code category. However, the City Council reserves the right to itself the opportunity to adjust the rate in the following year if the CPI adjustment is insufficient to reimburse the City for the costs of providing levels of police services as approved by the City Council.
816
Ordinance No. XX-26 Page 3 of 4
In no event shall the tax per parcel for any fiscal year be less than the amount established for the previous fiscal year.
C. The taxes levied on each parcel pursuant to this Article shall be a charge upon the parcel and shall be due and collectible as set forth in Section 4, below.
Section 4. Collection and Administration.
A. Taxes as Liens Against the Property.
The amount of taxes for each parcel each year shall constitute a lien on such property, in accordance with Revenue and Taxation Code Section 2187, and shall have the same effect as an ad valorem real property tax lien until fully paid.
B. Collection.
The taxes on each parcel shall be billed on the secured roll tax bills for ad valorem property taxes and are to be collected in the same manner in which the County of Contra Costa collects secured roll ad valorem property taxes. Insofar as feasible and insofar as not inconsistent with this Ordinance, the times and procedure regarding exceptions, due dates, installment payments, corrections, cancellations, refunds, late payments, penalties, liens, and collections for secured roll ad valorem property taxes shall be applicable to the collection of this tax. Notwithstanding anything to the contrary in the foregoing, as to this tax:
i) The secured roll tax bills shall be the only notices required for this tax, and ii) The homeowners and veterans exemptions shall not be applicable because such exemptions are determined by dollar amount of value.
C. Costs of Administration by County.
The reasonable costs incurred by the County officers collecting and administering this tax shall be deducted from the collected taxes.
Section 5. Severability Clause.
If any article, section, subsection, sentence, phrase or clause of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion of this Ordinance. The voters of the Zone hereby declare that they would have adopted the remainder of this Ordinance, including each article, section, subsection, sentenced phrase or clause, irrespective of the invalidity of any other article, section, subsection, sentence, phrase or clause.
Section 6. Effective Date and Posting.
This Ordinance shall take effect immediately upon its confirmation by two-thirds of the voters voting within the Zone in an election to be held on February 16, 2026, so that 817
Ordinance No. XX-26 Page 4 of 4
taxes shall first be collected hereunder for the tax year beginning July 1, 2026. If not confirmed by two-thirds of the voters participating in the election, this Ordinance and the tax approved herein shall not become effective.

FOR FISCAL YEAR 2025/2026
The tax rates shown in this schedule shall be automatically adjusted on July 1 of each year, beginning on July 1, 2016 by the increase in the Consumer Price Index for all Urban Consumers for the San Francisco-Oakland-Bay Area and applying that rate to the prior year amounts for each property use code category. However, the City Council reserves the right to itself the opportunity to adjust the rate in the following year if the CPI adjustment is insufficient to reimburse the City for the costs of providing levels of police services as approved by the City Council.

SUBJECT: Adopt a Resolution of the Successor Agency to the Oakley Redevelopment Agency, Approving the Recognized Obligations Payment Schedule (ROPS) and Administrative Budget for the Fiscal Year of July 2026 through June 2027
Background and Analysis
Effective February 1, 2012, the Oakley Redevelopment Agency was dissolved and, the Oakley Redevelopment Agency assets and liabilities were distributed to a Successor Agency. The City elected to become the Successor Agency to the Oakley Redevelopment Agency, and on February 1, 2012, the Oakley Redevelopment Agency’s remaining assets and liabilities were transferred to the Successor Agency.
A successor agency may expend funds only for items on an approved ROPS and by law, a successor agency is required to prepare a forward-looking ROPS that reports one year of successor agency financial obligations. The ROPS presented for consideration this evening covers the July 2026 – June 2027 time period.
ABX1 26 required the establishment of an Oversight Board to review and approve the activities of the Successor Agency. Originally this board was established within each municipality. Effective July 1, 2018, the original Oversight Board expired by law, and a new countywide oversight board was established.
Once approved by the Successor Agency, the ROPS will be brought to the Countywide Oversight Board for the Successor Agency for their approval, and then remitted to the State Department of Finance (DOF) for their review. The Oversight Board review is scheduled for January 26, 2026.
The DOF prescribes the method and form requirements for the ROPS and has established the reporting template to be used by successor agencies. The ROPS also contains the administrative budget for the Successor Agency. The Successor Agency's "administrative cost allowance", as defined and authorized pursuant to Health & Safety Code Section 34171(b) (HSC 34171), is a minimum reimbursement of $250,000 for the entire 2026-2027 fiscal year and requires an annual approval of the Administrative Budget.

As this item is for the Successor Agency and requires final approval by the County oversight board, it is not related to our Oakley Strategic Plan 27+.
Fiscal Impact
The adoption of the ROPS allows the Successor Agency to pay the obligations of the former Oakley Redevelopment Agency. The Administrative Budget allows for reimbursement of $250,000 of administrative costs for the July 2026 – June 2027 time period. A total of $250,000 in administrative cost reimbursements have been requested for the 2026-27 fiscal year.

SUBJECT: Adopt a Resolution approving a Change to the Café Costa Meal Program for Studio 55
Background and Analysis
On May 1, 2025, the City of Oakley opened the doors of Studio 55 which is currently providing programming and aging services to community members 55 plus. On July 1, 2025, we increased the Café Costa lunch program from one day a week to four days a week. This program has been very successful and well attended by Studio 55 members.
Cafe Costa is funded through Contra Costa County and utilizes a third-party vendor, Trio, that actually supplies the meals. In November we were notified by the County that the program is currently tracking to exceed the budget for the current fiscal year.
To ensure the County is able to complete fiscal year 2025/2026 within the approved budget, staff was informed that a daily or monthly cap would be put in place for each location serving meals. In December staff received the following statistics from the program regarding our meal service.
Staff was provided the option of a daily cap or a monthly cap and has determined that a monthly cap provides for a greater number of community members being served. As you can see from the chart our monthly average is 409 meals and that will be reduced by 127 meals per month beginning January 1, 2026. As part of the Approved and

O (925) 625-7000 | F (925) 625-9859 | www.CI.Oakley.CA.US cap there are stricter rules being implemented which will not allow us to serve anyone under the age of 60. While this age limit does have some affect on our community, the majority of our members who participate in the meal program are over the age of 60. Less than 2% of our monthly average is under the age of 60.
As presented to us from the County, this is only expected to affect the current fiscal year and should not roll into future fiscal years.
While still actively exploring options, the following options are up for consideration:
1. Each meal is $6.20. The City could opt to not cap our services and to continue to provide services to those ages 55-59. This would mean the City would be responsible for paying Trio directly for these meals. The potential cost would be approximately $800 per month for 6 months.
This would cost the City approximately $5,000 from January to June 2026.
2. Stop serving meals once our cap is reached each month and begin serving again at the start of a new month.
3. Implement Option 1 and also set a City cap of not to exceed to reduce the cost to the City.
Staff would recommend Option 1 through June 30, 2026. Should the program not receive the needed funding from the County in FY 2026/2027 staff would recommend re-evaluating at that time. This program has proven to be a tremendous need in our community. Not only has this brought community members to Studio 55 in need of a hot meal, but it has also provided them with friendship, a place of belonging and a place they can call home.
Staff would also like to ask for flexibility when it comes to how we manage the coming months. This cap is being applied to all communities that offer Café Costa services. With this in mind, there is potential that we have other City’s members trying to find a space in surrounding cities to participate. While our contract with the County does not allow us to turn people away, they are looking into how we manage this given the current times.
While we do not want to exclude anyone from our program, staff feels it is important to ensure those that have been part of the Oakley Café Costa program for the last 6 months, are those that have the first option to continue in the program. Most of these participants are Oakley residents with some from neighboring cities. Staff would like to continue to offer to those that have consistently been part of the 831

Consistency with the Oakley Strategic Plan 27+
This item is consistent with the Strategic Plan 27+ goal for Community and Collaborative Partnerships in building a strong community and collaborative partnerships to be mutually beneficial and shared goals.
Fiscal Impact
The fiscal impact utilizing the staff recommendation of option 1 would be approximately $5,000 for the rest of fiscal year 2025/2026. Staff would recommend this come from General Fund contingency and therefore a budget amendment is not requested at this time.
