the project will not have a significant effect. Thus, as Claremont itself recognized, [c]onsideration is not to be given contrary evidence supporting the preparation of a negative declaration.
(2004) 124 Cal.App.4th 903, 935 (internal citations and quotations omitted).

In cases where it is not clear whether there is substantial evidence of significant environmental impacts, CEQA requires erring on the side of a “preference for resolving doubts in favor of environmental review.” Mejia v. City of Los Angeles (2005) 130 Cal.App.4th 322, 332 “The foremost principle under CEQA is that the Legislature intended the act to be interpreted in such manner as to afford the fullest possible protection to the environment within the reasonable scope of the statutory language. Friends of Mammoth v. Bd. of Supervisors (1972) 8 Cal.3d 247, 259.

C. Background Concerning CEQA Exemptions.

Where a lead agency chooses to dispose of CEQA by asserting a CEQA exemption, it has a duty to support its CEQA exemption findings by substantial evidence, including evidence that there are no applicable exceptions to exemptions. This duty is imposed by CEQA and related case law. CEQA Guidelines, § 15020 (lead agency shall not knowingly release a deficient document hoping that public comments will correct the defects); see Citizens for Environmental Responsibility v. State ex rel. 14th Dist. Agriculture Assn. (2015) 242 Cal.App.4th 555, 568 (lead agency has the burden of demonstrating that a project falls within a categorical exemption and must support the determination with substantial evidence); accord Assn. for Protection etc. Values v. City of Ukiah (1991) 2 Cal.App.4th 720, 732 (lead agency is required to consider exemption exceptions where there is evidence in the record that the project might have a significant impact.) The duty to support CEQA and exemption findings with substantial evidence is also required by the Code of Civil Procedure (“CCP”) and case law on administrative or traditional writs. Under the CCP, an abuse of discretion is established if the decision is unsupported by the findings, or the findings are unsupported by the evidence. CCP, § 1094.5(b). In Topanga Assn. for a Scenic Community v. County of Los Angeles, our Supreme Court held that implicit in CCP section 1094.5 is a requirement that the agency which renders the challenged decision must set forth findings to bridge the analytic gap between the raw evidence and ultimate decision or order. (1977) 11 Cal.3d 506, 515 (internal citations and quotations omitted). The lead agency’s findings may be determined to be sufficient if a court has no trouble under the circumstances 166

discerning the analytic route the administrative agency traveled from evidence to action. West Chandler Blvd. Neighborhood Assn. vs. City of Los Angeles (2011) 198 Cal.App.4th 1506, 1521-1522 (internal citations and quotations omitted). However, “mere conclusory findings without reference to the record are inadequate.” Id. at p. 1521 (finding city council findings conclusory, violating Topanga Assn. for a Scenic Comm.).

Further, CEQA exemptions must be narrowly construed to accomplish CEQA’s environmental objectives. Cal. Farm Bureau Federation v. Cal. Wildlife Conservation Bd. (2006) 143 Cal.App.4th 173, 187; accord Save Our Carmel River v. Monterey Peninsula Water Management Dist. (2006) 141 Cal.App.4th 677, 697 (“These rules ensure that in all but the clearest cases of categorical exemptions, a project will be subject to some level of environmental review.”)
Finally, CEQA procedures reflect a preference for resolving doubts in favor of environmental review. See Pub. Res. Code, § 21080(c) (an EIR may be disposed of only if there is no substantial evidence, in light of the entire record before the lead agency, that the project may have a significant effect on the environment or revisions in the project); CEQA Guidelines §§ 15061(b)(3) (common sense exemption only where it can be seen with certainty); 15063(b)(1) (prepare an EIR if the agency determines that there is substantial evidence that any aspect of the project, either individually or cumulatively, may cause a significant effect on the environment, regardless of whether the overall effect of the project is adverse or beneficial]; 15064(h) (the agency must consider cumulative impacts of past, current, and probable future projects); 15070 (a negative declaration may be prepared only if there is no substantial evidence, in light of the whole record, that the project may have a significant effect on the environment, or project revisions would avoid the effects or mitigate the effects to a point where clearly no significant effects would occur, and there is no substantial evidence, in light of the whole record, that the project as revised may have a significant effect on the environment); No Oil, Inc., supra, 13 Cal.3d at pp. 83-84 (significant impacts are to be interpreted so as to afford the fullest possible protection).

III. THE PROJECT DOES NOT QUALIFY FOR THE CLASS 32
“INFILL” CATEGORICAL EXEMPTION.

CEQA exemptions must be construed narrowly. County of Amador v. El Dorado County Water Agency (1999) 76 Cal.App.4th 931, 966. With respect to Class 32 exemptions for 167

in-fill development projects, in addition to not being subject to the six exemption exceptions identified in CEQA Guidelines, § 15300.2, the Project must also meet all of the conditions identified in CEQA Guidelines, § 15332, including:
(a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations;
(b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses;
(c) The project site has no value as habitat for endangered, rare, or threatened species;
(d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality; and (e) The site can be adequately served by all required utilities and public services.

The Project here fails to comply with all of the required conditions, and thus, does not qualify for the Class 32 “Infill” Exemption.

A. The City Lacks Substantial Evidence to Support Its Determination that the Project Is Consistent With the Applicable Plans and Regulations.

On April 19, 2011, the City of Ontario City Council approved and adopted the Ontario Airport Land Use Compatibility Plan (“ALUCP”), which established the Airport Influence Area for Ontario International Airport—thus limiting future land uses and development within the Airport Influence Area as they relate to noise, safety, airspace protection, and overflight impacts of current and future airport activity.

Planning Commission Staff Report, Item C (“Staff Report”), p. 631. The Planning Commission found that the Project “will be consistent with the policies and criteria set forth within the ALUCP without providing any analysis or justification regarding the details as to the compatibility factors, including Safety Criteria, Safety Zones, Noise Criteria, and Noise Impact Zones, to name several. The City now concludes that—after having considered the information contained in the application and supporting documentation, and having reviewed elements of the Project as they relate to Safety Criteria, Noise Criteria and Noise Impact Zones, and others—the Project “was evaluated and found to be consistent with the policies and criteria of the OTP ALUCP[,]” yet it does not offer any analysis or evaluation for review. Id. 168

Additionally, the Staff Report concludes that the “proposed Project is consistent with the principles, goals and policies contained within the Vision, Governance, Policy Plan (general plan), and City Council components of The Ontario Plan (“TOP”). The Staff Report goes on to list certain elements of the TOP, yet fails to address how the Project, specifically, aligns with any of those elements. Staff Report, pp. 8-12. The City makes certain conclusory, yet unsupported, remarks that the Project will contribute to the establishment of one of the TOP’s goals and will promote one of the City’s policies. December Staff Report, pp. 116-117.

The Staff Report concludes that the Project is consistent with the applicable general plan designation, policies, and zoning designation and regulations, yet it fails to address its compliance with the Plans listed above. Staff Report, pp. 12, 116-117. A greater and more detailed analysis is required to meet the substantial evidence standard for purposes of designating the Project exempt from CEQA compliance.

B. The City Lacks Substantial Evidence to Support Its Determinations of the Project’s Significant Impacts.

As detailed above, in order to qualify for the Class 32 Exemption, project approval cannot result in any significant effects relating to traffic, noise, air quality, or water quality. CEQA Guidelines, § 15332. Lead agencies are required to present substantial evidence to support findings under CEQA. The CEQA Guidelines note that substantial evidence means “enough relevant information and reasonable inferences from this information that a fair argument can be made to support a conclusion.” CEQA Guidelines, § 15384(a).

Here, the City concludes that the “design of the subdivision or the proposed improvements thereon are not likely to cause substantial environmental damage[.]” Staff Report, p. 117. Unfortunately, this contention fails to address the Project as a whole and instead focuses on the subdivision and improvements and fails meet the minimum statutory requirement of no significant effects as well as the substantial evidence standard. The impacts which may be deemed potentially significant and this in need of detailed analysis and circulation for public comment in an EIR are listed in more detail below.

The City concludes that the Project “would not result in any significant effects related to traffic, noise, air quality, or water quality” given that the nature of its proposed buildings (hotel and fast-food restaurant) are similar to—and would therefore have 169

“no greater impact” than—other allowed uses and development projects within the Convention Center Support Commercial zoning district. Staff Report, p. 13.

This argument is baseless. The potential or actual effects of similar or nearby—and entirely unrelated—uses and development projects are not at issue and have no bearing on whether the Project at hand may have significant environmental effects on traffic, noise, air quality, or water quality. To conclude that the Project is similar to other allowed uses and would, for that reason, have no greater impacts is illogical and constitutes a blatant disregard and evasion of the type of environmental review CEQA mandates for such projects.

The City also further supports its contention that the Project is “not likely to cause substantial environmental damage” by arguing that the Project site is “not located in an area that has been identified as containing species identified as a candidate, sensitive, or special status species in local or regional plans, policies or regulations or by the California Department of Fish and Wildlife or the U.S. Fish and Wildlife Service[.]” Staff Report, p. 117. Fatally, the City has failed to provide any support or evidence for its conclusion and has failed to address or account for other environmental impacts unrelated to sensitive or special-status species, air quality, or water quality.

1. Traffic Impacts.

Whereas full-service hotels typically offer guests a more comprehensive experience with features such as restaurants, bars, spas, and recreation facilities, the Project here involves a limited-service hotel. Staff Report, pp. 3. As confirmed in the Staff Report, the proposed Everhome Suites will have limited or no additional amenities and will therefore “rely on other facilities in the vicinity to fill the gaps in service” that would otherwise be provided on-site at a full-service hotel. Ibid.

Additionally, “users of this type of…hotel typically stay for more extended timeframes and include business travelers and families who are looking to relocate[.]” Ibid. In fact, in September 2022, Choice Hotels’

be spending “little time on-site” and for potentially up to several weeks is cause for concern in the context of potential traffic impacts. Ibid.

These elements of the proposed hotel clearly give rise to the potential for traffic- related impacts close to and far from the Project site that could not possibly be taken into consideration with any level of accuracy or analyzed sufficiently to make the determination that the Project will not have any traffic-related impacts. Therefore, the City lacks substantial evidence to support its determination that the Project will not have significant impacts related to traffic and thus, it does not qualify for the Class 32 Exemption.

2. Air Quality Impacts.

CEQA requires mandatory findings of significant impacts where, among other things, a project’s cumulative impacts with other similar projects may have a significant impact and also where the environmental effects of a project will cause substantial adverse effects on human beings, either directly or indirectly. CEQA Guidelines, §§ 15065(a)(3)-(4).

The Project site is across the street, and less than 200 feet away from the San Bernardino Freeway (“I-10”) at its closest point—a critical factor which must be considered in a project-specific environmental analysis. The I-10 is among the top 25 most-used freeways by Annual Average Daily Traffic (“AADT”) and received roughly 355,000 cars in 2019.
10 The Project’s alarmingly close proximity to the I-10 and the subsequent air pollution risks—especially considering that many of the Everhome Suites guests will be staying for longer than a few nights—both individually and cumulatively with other projects nearby, require mandatory findings of significance.

The Project is one of many projects built, proposed, or underway next to the I-10, and, if approved, will be one of roughly 12 hotels or motels along the highway within the immediate vicinity of the Project site. The Project will increase traffic on the freeway due to its proposed density of extended-stay accommodations (along with increased traffic as a result of the Chick-fil-A and increased traffic in conjunction with other nearby hotels and developments). Additionally, the I-10 will soon be undergoing an expansion that will add 40 additional miles of freeway capacity and likely increase

the number of cars using it on a daily basis.11 These facts together meet the cumulative impacts prong under CEQA Guidelines, § 15065(a)(3), and requires mandatory findings of significance and that an EIR be prepared—therefore disqualifying any claimed exemption.

Second, because of its proximity to the I-10, the Project will cause substantial adverse effects (and particularly air pollution) on human beings, either directly or indirectly, under CEQA Guidelines, § 15065(a)(4). The Project proposes sensitive quasi- residential uses and is within 1000 feet of freeway—hence, it is subject to Freeway Advisory Notice and additional requirements to ensure the sensitive uses do not get affected by medical conditions caused by air pollution, including, but not limited to, asthma, heart attack, lung and breathing conditions, and cancer. 12 Further, the California Environmental Protection Agency Air Resources Board recommendations include “residences” among sensitive uses and cautions: “[a]void siting new sensitive land uses within 500 feet of a freeway, urban roads with 100,000 vehicles/day, or rural roads with 50,000 vehicles/day.” Although the Project proposes a hotel, its unique nature and accommodations gives rise to the likelihood that guests will be using it for extended periods, thus effectively qualifying the project as something of a residence and sensitive use for purposes of CEQA compliance.

The City has not met its burden of showing that such impacts were studied and deemed to be less than significant—consequently, an EIR must be prepared.

3. Noise Impacts.

The Project site directly abuts a residential community comprised of multiple-family residential dwellings, separated only by a two-lane road. Staff Report, pp. 1-2. Such residents may be directly affected by the noise generated from the Project’s construction and ongoing operations. The City has failed to address the impacts the Project may have on these homes and potential sensitive receptors, 13 and simply
concludes in its CEQA exemption justification letter that the Project has been “conditioned” to be sensitive to the residential land use district to the west through

having placed the noise- and traffic-generating activities toward the east of the Project site. Staff Report, p. 186. It fails to provide any information at all about what days and times the construction will take place, how loud such activities may be, or what measures will be implemented to mitigate such impacts.

Attached to the December Staff Report is the Land Development Division Conditions of Approval which mandates that the Project shall be constructed and continuously operated in a manner so as not to exceed the maximum interior and exterior noised levels set forth in Ontario Municipal Code Title 5 (Public Welfare, Morals, and Conduct), Chapter 29 (Noise). December Staff Report, p. 191.

Nevertheless, statutory compliance, which is insufficient to prevent significant adverse impacts, is similarly insufficient to conclude that no adverse impacts will occur. See Californians for Alternatives to Toxics v. Dept. of Food & Agric. (2005) 136 Cal.App.4th 1; Ebbets Pass Forest Watch v. Dept. of Forestry & Fire Protection (2008) 43 Cal.App.4th 936, 956. Additionally, compliance with the Ontario Municipal Code (“Code”) does not preclude Applicant from providing a detailed analysis about how and to what degree the noise generated from the Project’s construction activities will affect the neighboring community. For example, the Code allows for construction to begin as early as 7:00 am and end at 6:00 pm on weekdays, and from 9:00 am to 6:00 pm on weekends.
14 Should Applicant choose to engage construction-related activities during all permitted hours pursuant to the Code, nearby residents and businesses will undoubtedly be impacted. Thus, Applicant should be required to provide more detailed information about the potential noise impacts the Project will have on its surrounding community.

The City’s reliance on Applicant’s regulatory compliance cannot rectify its failure to conduct a Project-specific analysis as to its anticipated noise impacts. Without a more focused and in-depth analysis, it is impossible to determine the magnitude of the Project’s noise-related impacts on the homes directly adject to the Project site, though it is safe to say that there will be at least some impact—thus necessitating environmental review.

4. Hydrology and Water Quality Impacts.

CEQA requires that the City quantify and analyze the Project’s impacts on water resources. To this aim, the City must analyze whether the Project will have to rely on groundwater resources, and if so, the quantity of groundwater it will be relying on.

Applicant’s Preliminary Water Quality Management Plan (“PWQMP”) addresses the Project’s compliance with stormwater discharge and water quality requirements, and claims itself to be a “planning tool to improve integration of required water quality elements, stormwater management, water conservation, rainwater harvesting and re- use, and flood management in land use planning and the City’s development process.” PWQMP, p. 2. The PWQMP fails to address anything substantive relating to the Project’s water impacts. Additionally, the PWQMP here was submitted April 15, 2022, and, upon reviewing documents provided to this office in the City’s PRA productions on July 7, 2022, and December 9, 2022, it is clear that certain elements of the Project have been altered since the PWQMP was issued. In order for the PWQMP to effectuate its intended purpose of “assist[ing] project applicants and planners in properly designing and laying out project sites so that water quality may be incorporated in the most effective manner and at the lowest cost for the developer[,]” and evolve into a Final Water Quality Management Plan (“FWQMP”), the PWQMP must focus on the Project details as they have been presented to the Planning Commission today—not what they were roughly nine months ago. For this reason, the PWQMP must be revised and recirculated to focus on the Project as it currently stands.

The City relies on groundwater produced from a sub-basin of the Upper Santa Ana Valley Groundwater Basin named the Chino Basin, which is actively managed by the Chino Basin Watermaster.

However, all of these water resources are decreasing and are currently at record lows given the current state of the climate and to what uses the State of California’s water resources are being appropriated for. California is in a state of severe drought, and as the Director of California’s Department of Water Resources (“DWR”) states, “[w]e are experiencing climate change whiplash in real time” and “[w]hile we had hoped for more rain and snow, DWR has been preparing for a third consecutive year of drought” by reducing State Water Project allocation to five percent of requested supplies for 2022—10 percent less than the 15 percent allocation previously set by DWR. The Colorado River, of which between 55 and 65 percent of California’s fresh water derives, is also in an extreme state of drought and recently hit historically low levels. The U.S. Department of Interior has stated that “[p]rolonged drought and low runoff conditions accelerated by climate change have led to historically low water levels in Lakes Powell and Mead,”
17 and in August 2021, federal officials cut Colorado
River water allocations to several southwestern states.18 In fact, Lake Mead is now more than 182 feet lower than its ‘full pool’ maximum level and is expected to drop another 20 feet by September 2023.
19 Further, the PWQMP does not mandate that the Project include certain measures that would increase its conservation of water and reduce its harmful environmental impacts. Some measures mentioned in the PWQMP but not adopted include installation of “engineered soil” to increase uptake/soil storage capacity and/or evapotranspiration, of rainwater harvesting and use equipment, and of proprietary biofiltration vaults/devices for on-site storm drain inlets. According to the PWQMP, such devices are designed to control stormwater pollutants where it is not feasible to install on-site Site Design/LID BMPs. These measures are indispensable in the context of reducing a development’s negative environmental impacts and cannot be glossed over in light of “reducing costs for developers.” PWQMP, p. 6. PWQMP,

pp. 4, 6. The PWQMP is silent as to why such measures have not been incorporated into the Project and points to the possibility that the PWQMP is not actually doing all it can to incorporate “water quality . . . in the most effective manner[,]” but rather is focusing primarily on its other intended purpose of addressing water quality “at the lowest cost for the developer.” PWQMP, p. 2.

Lastly, given the size and scope of the Project, it seems that the natural drainage of water in and from the site will be altered during construction—suggesting significant environmental impacts which must be studied.

Without a detailed assessment of the Project’s water demands, it is unclear whether the Project will meet future demands or whether it will significantly impact the region’s scarce water resources. Therefore, a thorough, CEQA-compliant environmental analysis is necessary to determine the magnitude and severity of the impacts the Project will have on water resources and, if those impacts are significant, what measures may be engaged to mitigate such impacts.

C. The City Lacks Substantial Evidence to Support Its Conclusion That Public Utilities Adequately Serve the Project.

The AR concludes that “[p]ublic utilities (Water and sewer) are available to serve the Project.” AR, pp. 7, 13. It then shifts focus onto Applicant’s submission of its PWQMP without addressing the issue of utilities further. More evidence to support this contention is required in order to comply with CEQA Guidelines, subsection (e).

Both Applicant and the City should be immediately required to provide as much information about what utility-related buildouts will be necessary to adequately supply utilities to the Project site (both during construction and operation), and the environmental effects such construction would produce before the City permits the Project to proceed.

IV. CONCLUSION.

In light of the aforementioned, SWMSRCC respectfully requests that: (1) the City deem the Project not exempt from CEQA review; (2) prepare and circulate a thorough, project-specific Environmental Impact Report; and, (3) order Applicant to revise the Project to ensure its consistency with all applicable laws and regulations.

Subject: Local Hire Requirements and Considerations for Greenhouse Gas Modeling Dear Mr. Tsai,
Soil Water Air Protection Enterprise (“SWAPE”) is pleased to provide the following draft technical report explaining the significance of worker trips required for construction of land use development projects with respect to the estimation of greenhouse gas (“GHG”) emissions. The report will also discuss the potential for local hire requirements to reduce the length of worker trips, and consequently, reduced or mitigate the potential GHG impacts.

Worker Trips and Greenhouse Gas Calculations
The California Emissions Estimator Model (“CalEEMod”) is a “statewide land use emissions computer model designed to provide a uniform platform for government agencies, land use planners, and environmental professionals to quantify potential criteria pollutant and greenhouse gas (GHG) emissions associated with both construction and operations from a variety of land use projects.”1 CalEEMod quantifies construction-related emissions associated with land use projects resulting from off-road construction equipment; on-road mobile equipment associated with workers, vendors, and hauling; fugitive dust associated with grading, demolition, truck loading, and on-road vehicles traveling along paved and unpaved roads; and architectural coating activities; and paving.2
The number, length, and vehicle class of worker trips are utilized by CalEEMod to calculate emissions associated with the on-road vehicle trips required to transport workers to and from the Project site during construction.3

2 Specifically, the number and length of vehicle trips is utilized to estimate the vehicle miles travelled (“VMT”) associated with construction. Then, utilizing vehicle-class specific EMFAC 2014 emission factors, CalEEMod calculates the vehicle exhaust, evaporative, and dust emissions resulting from construction-related VMT, including personal vehicles for worker commuting.4
Specifically, in order to calculate VMT, CalEEMod multiplies the average daily trip rate by the average overall trip length (see excerpt below):
“VMTd = Σ(Average Daily Trip Rate i * Average Overall Trip Length i) n Where:
n = Number of land uses being modeled.”5
Furthermore, to calculate the on-road emissions associated with worker trips, CalEEMod utilizes the following equation (see excerpt below):
“Emissionspollutant = VMT * EFrunning,pollutant
Where:

Emissionspollutant = emissions from vehicle running for each pollutant VMT = vehicle miles traveled
EFrunning,pollutant = emission factor for running emissions.”6 Thus, there is a direct relationship between trip length and VMT, as well as a direct relationship between VMT and vehicle running emissions. In other words, when the trip length is increased, the VMT and vehicle running emissions increase as a result. Thus, vehicle running emissions can be reduced by decreasing the average overall trip length, by way of a local hire requirement or otherwise.

Default Worker Trip Parameters and Potential Local Hire Requirements As previously discussed, the number, length, and vehicle class of worker trips are utilized by CalEEMod to calculate emissions associated with the on-road vehicle trips required to transport workers to and from the Project site during construction.7 In order to understand how local hire requirements and associated worker trip length reductions impact GHG emissions calculations, it is important to consider the CalEEMod default worker trip parameters. CalEEMod provides recommended default values based on site-specific information, such as land use type, meteorological data, total lot acreage, project type and typical equipment associated with project type. If more specific project information is known, the user can change the default values and input project- specific values, but the California Environmental Quality Act (“CEQA”) requires that such changes be justified by substantial evidence.8 The default number of construction-related worker trips is calculated by multiplying the

3 number of pieces of equipment for all phases by 1.25, with the exception of worker trips required for the building construction and architectural coating phases.9 Furthermore, the worker trip vehicle class is a 50/25/25 percent mix of light duty autos, light duty truck class 1 and light duty truck class 2, respectively.”10 Finally, the default worker trip length is consistent with the length of the operational home-to-work vehicle trips.11 The operational home-to-work vehicle trip lengths are:
“[B]ased on the location and urbanization selected on the project characteristic screen. These values were supplied by the air districts or use a default average for the state. Each district (or county) also assigns trip lengths for urban and rural settings” (emphasis added). 12 Thus, the default worker trip length is based on the location and urbanization level selected by the User when modeling emissions. The below table shows the CalEEMod default rural and urban worker trip lengths by air basin (see excerpt below and Attachment A).13

4 As demonstrated above, default rural worker trip lengths for air basins in California vary from 10.8- to 19.8- miles, with an average of 16.47 miles. Furthermore, default urban worker trip lengths vary from 10.8- to 14.7- miles, with an average of 11.17 miles. Thus, while default worker trip lengths vary by location, default urban worker trip lengths tend to be shorter in length. Based on these trends evident in the CalEEMod default worker trip lengths, we can reasonably assume that the efficacy of a local hire requirement is especially dependent upon the urbanization of the project site, as well as the project location.

Practical Application of a Local Hire Requirement and Associated Impact To provide an example of the potential impact of a local hire provision on construction-related GHG emissions, we estimated the significance of a local hire provision for the Village South Specific Plan (“Project”) located in the City of Claremont (“City”). The Project proposed to construct 1,000 residential units, 100,000-SF of retail space, 45,000-SF of office space, as well as a 50-room hotel, on the 24-acre site. The Project location is classified as Urban and lies within the Los Angeles-South Coast County. As a result, the Project has a default worker trip length of 14.7 miles.14 In an effort to evaluate the potential for a local hire provision to reduce the Project’s construction-related GHG emissions, we prepared an updated model, reducing all worker trip lengths to 10 miles (see Attachment B). Our analysis estimates that if a local hire provision with a 10-mile radius were to be implemented, the GHG emissions associated with Project construction would decrease by approximately 17% (see table below and Attachment C).

As demonstrated above, by implementing a local hire provision requiring 10 mile worker trip lengths, the Project could reduce potential GHG emissions associated with construction worker trips. More broadly, any local hire requirement that results in a decreased worker trip length from the default value has the potential to result in a reduction of construction-related GHG emissions, though the significance of the reduction would vary based on the location and urbanization level of the project site.

This serves as an example of the potential impacts of local hire requirements on estimated project-level GHG emissions, though it does not indicate that local hire requirements would result in reduced construction-related GHG emission for all projects. As previously described, the significance of a local hire requirement depends on the worker trip length enforced and the default worker trip length for the project’s urbanization level and location.
