2. Method to Accomplish Work
Ontario Municipal Utilities Company (OMUC) is implementing a significant recycled water infrastructure expansion along Euclid Avenue and Riverside Drive to reduce reliance on imported potable water supplies and improve long-term water sustainability within the City.

The project includes:
• Approximately 3,025 LF of 8-inch PVC recycled water main along Flora Street, Vine Avenue, and F Street • Approximately 5,175 LF of 8-inch PVC recycled water main along Euclid Avenue between Holt Boulevard and 4th Street
• Approximately 175 LF of 8-inch PVC main along B Street and E Street • Approximately 11,150 LF of 24-inch CML&C welded steel pipe recycled water main along Riverside Drive between Euclid Avenue and Vineyard Avenue
• Approximately 125 LF of 8-inch PVC recycled water main near Euclid Avenue and Riverside Avenue The plans indicate extensive work within heavily traveled arterial corridors, including Euclid Avenue and Riverside Drive. Construction will occur during restricted daytime hours (8:30 a.m. to 3:30 p.m.) and must be completed within a 450-calendar-day contract duration .

This project presents several notable complexities:
• Installation of large-diameter 24-inch welded steel recycled water main with double-welded joints and field coating requirements along Riverside Drive
• Multiple valve installations including 24-inch butterfly valves and associated appurtenances • Numerous air release/vacuum assemblies, blow-off assemblies, and service connections • Extensive pavement restoration including grind and overlay limits • Work adjacent to existing high-pressure gas, overhead electrical, and underground utility corridors as shown throughout the Riverside Drive plan sheets
• Traffic signal loop removals and replacements
• Irrigation conversions and restoration
Because the work spans two major corridors and multiple intersecting streets, coordination of sequencing, testing, tieins, traffic control, and stakeholder communication will be critical to project success. AKM understands that our role is to provide comprehensive Construction Management and Inspection support throughout pre-construction, construction, and post-construction phases. We recognize that this project requires not only strong field oversight, but also disciplined documentation control, proactive issue resolution, and schedule management to ensure successful completion within the allotted 450 days.

Proposed Method to Accomplish the Work
AKM has thoroughly reviewed the Scope of Services and accepts it in its entirety. Successful delivery of UT1072 will require disciplined construction management, experienced pipeline inspection, and proactive coordination across multiple stakeholders. Our methodology is built around proactive planning, disciplined field oversight, structured documentation, and constant communication with OMUC. Based on our review of the plans RFP, and al documents provided with this solicitation, the most critical project challenges include:
• Management of long linear 24-inch welded
steel pipeline installation
• Coordination of multiple tie-ins, testing, and
flushing
• Working within high-traffic arterial corridors
under restricted working hours
• Utility conflict mitigation
• Maintaining strict schedule control over a
450-day contract
• Comprehensive documentation and claim
avoidance

1. Pre-Construction Phase – Setting the Foundation
Contract Document Review and Risk Identification
1106
AKM Prop. 26-1017 Page-4
Contract. UT1072
Prior to construction, AKM will conduct a comprehensive review of the plans, specifications, and special provisions. We will prepare a written risk matrix identifying potential construction challenges and bring these to OMUC’s attention early to minimize disruption. Particular focus will be placed on:
• 24-inch CML&C WSP installation
requirements, welding procedures, and
coating specifications
• Locations of steel casings, reducers, blind
flanges, and future connection points
• Utility conflict areas identified on plan sheets
• Traffic signal loop replacement areas
• Pavement restoration limits and grind/overlay
requirements
Document Control Implementation
AKM will establish a structured document control system consistent with OMUC requirements. Structured workflows will be programmed at the outset to ensure accountability and response tracking. We propose use of a cloud-based system, Procore, to manage:
• Submittals and RFIs
• Change orders
• Daily reports
• Photo documentation
• Decision log
• Schedule tracking
• Pay applications
Utility Coordination
Given the extent of work along Riverside Drive and Euclid Avenue, AKM will coordinate preliminary potholing verification and confirm conflict resolution strategies with the Contractor and Engineer of Record prior to trenching operations.

2. Construction Phase – Proactive Field Leadership
Full-Time Inspection and Oversight
As required, AKM will provide a superbly qualified inspector onsite during all construction activities. Non-conforming work will be documented promptly and corrective action required in writing. Inspection focus areas will include:
• Proper trench excavation and shoring
• Pipe bedding, installation, and joint restraint
• Weld inspection and coating verification for
24-inch steel main
• Installation of valves, air/vac assemblies, and
blow-offs
• Service connections and meter installations
• Traffic control compliance
• SWPPP/WPCP compliance
• Pavement restoration
Large-Diameter Steel Main Installation Oversight
The 24-inch CML&C welded steel pipe along Riverside Drive represents the most technically demanding component of the project. AKM will:
• Verify welder qualifications and WPS
compliance
• Monitor joint preparation, welding,
inspection, and coating
• Confirm proper installation of butterfly valves
and reducers
• Oversee hydrostatic testing and coating
repairs
• Coordinate AR/AV assembly installations
Improper steel main installation can result in costly rework and delays; therefore, heightened oversight will be maintained.

Testing, Flushing, and Tie-In Coordination
Before any tie-in to the recycled water system, AKM will coordinate:
• Hydrostatic testing
• Flushing
• Chlorination and dechlorination
• Regulatory-compliant discharge
Coordination with OMUC Operations will be scheduled well in advance to minimize service disruptions. 1107
AKM Prop. 26-1017 Page-5
Contract. UT1072
Schedule Management
With a 450-day contract duration and limited daily working hours, schedule control is critical. AKM will:
• Conduct a detailed baseline CPM schedule
review
• Verify logical ties between submittals,
procurement, and field activities
• Monitor weekly look-ahead schedules
• Issue Weekly Statement of Working Day
reports
• Identify early warning signs of delay
Special attention will be given to steel pipe procurement lead times and specialty valve deliveries.

Change Order and Claims Management
AKM will proactively identify potential claims and maintain a claims log. For each proposed change order, we will:
• Evaluate entitlement
• Perform independent quantity and cost
review
• Assess schedule impacts
• Provide written recommendations to OMUC
Early documentation and timely analysis will reduce dispute potential.

Public and Traffic Coordination
Work along Euclid Avenue and Riverside Drive requires disciplined traffic control oversight. AKM will:
• Monitor contractor compliance with approved
traffic control plans
• Verify signal loop replacements
• Ensure pedestrian access is maintained
• Coordinate with City staff for public
communication

3. Post-Construction – Efficient Closeout
AKM will lead punch list development with OMUC staff and track corrective actions through completion.

Closeout efforts will include:
• Verification of record drawings
• Warranty documentation
• Lien releases
• Final quantity reconciliation
• Final pay application review
• Archiving of project documents
Our goal is clean, defensible project closeout without residual disputes.

The Euclid Avenue Recycled Water System Project is a major capital investment that spans two critical corridors and includes both distribution-scale PVC pipeline and large-diameter welded steel transmission main. Its success depends on proactive leadership, disciplined inspection, and structured documentation.

AKM’s approach emphasizes:
• Early risk identification
• Continuous schedule control
• Aggressive documentation management
• Technical oversight of steel pipeline
installation
• Proactive claim avoidance
• Full alignment with OMUC staff
We are prepared to support OMUC from pre-construction through final acceptance and ensure this project is delivered safely, efficiently, and within the contract duration.

Item No: 16
SUBJECT: A RESOLUTION DECLARING CITY-OWNED PROPERTY LOCATED AT 801 S.

MOUNTAIN AVENUE (ASSESSOR'S PARCEL NO. 1011-382-09) AND 1045 W.

MISSION BOULEVARD (ASSESSOR'S PARCEL NO. 1011-382-65) AS EXEMPT

SURPLUS LAND FOR AFFORDABLE HOUSING DEVELOPMENT

CITY OF ONTARIO
Agenda Report
July 7, 2026
SECTION:

PUBLIC HEARINGS
RECOMMENDATION: That the Housing Authority adopt a Resolution declaring the two properties located at 801 S. Mountain, identified with Assessor's Parcel No. 1011-382-09 and 1045 W. Mission Boulevard, identified with Assessor's Parcel No. 1011-382-65, as Exempt Surplus Land pursuant to Government Code Section 54221 (f) (1)(F).

THE FOLLOWING COUNCIL GOALS ARE BEING ACHIEVED:

Pursue City's Goals and Objectives by Working with Other Governmental Agencies Focus Resources in Ontario's Commercial and Residential Neighborhoods Invest in the Growth and Evolution of the City's Economy FISCAL IMPACT: There is no direct fiscal impact associated with this action. Adoption of the Resolution will allow the City to proceed with the process of developing affordable housing on the properties.

BACKGROUND & ANALYSIS: The Ontario Housing Authority ("OHA") owns approximately 1.28 acres of real property located at 801 S. Mountain, identified with Assessor's Parcel No. 1011-382-09, and 1045 W. Mission Boulevard, identified with Assessor's Parcel No. 1011-382-65, described and depicted in Exhibit "A" of the attached Resolution ("Properties"). Previously, three small commercial businesses occupied the Properties and a deteriorated motel that had become a nuisance to the surrounding area due to recurring illegal activity and frequent safety concerns. The site's condition negatively affected the area, posing challenges with lighting, safety, and neighborhood quality. OHA acquired the properties with the intent of facilitating future affordable housing development.

The Surplus Land Act ("SLA") (California Government Code Section 54220 et. seq.) establishes 1135
procedures that local agencies must follow before they sell or transfer public property that is no longer needed for government use. Under SLA, local agencies must formally classify public property as either "surplus land" or "exempt surplus land" and create written findings to support the classification.

New State legislation (AB 1486, effective January 1, 2020) strengthened the requirements of the Surplus Land Act by prioritizing the availability of surplus land for affordable housing development and other public uses. However, some properties qualify as exempt surplus land and are not subject to the notice, solicitation, and negotiation requirements otherwise required under the Act.

After review, Staff has determined that the Properties qualify as Exempt Surplus Land pursuant to Government Code Section 54221 (f)(1)(F). This exemption is applicable because a housing authority owns the Properties and they are designated for affordable housing development.

The proposed project will be a 100% affordable rental housing development that will provide longterm housing opportunities for low- and moderate-income households within the City. To ensure long-term affordability, the project will include a recorded affordability covenant requiring the units to remain affordable for at least 55 years, consistent with State funding requirements.

The Properties do not sit in any areas that would prevent qualifying for the exemption, including coastal zones, land adjacent to a historical unit of the State Parks System, land listed on or determined eligible for the National Register of Historic Places, or land located within the Lake Tahoe region.

Declaring the Properties as Exempt Surplus Land will allow OHA to move forward with facilitating affordable housing development at the Properties, supporting the City's housing goals and OHA's mission to expand housing opportunities and promote housing stability for low-income households.

Staff recommends the adoption of the Resolution, allowing the affordable housing project to move forward under State law.

WHEREAS, the development of the Property will further the OHA’s mission to expand the supply of affordable housing and promote housing stability within the community; and

WHEREAS, the OHA finds and determines that the Property will be utilized for affordable housing purposes and will be subject to enforceable affordability restrictions consistent with the requirements of Government Code Section 54221(f)(1)(F).

NOW, THEREFORE, BE IT RESOLVED BY THE City of Ontario Housing Authority, as follows:

SECTION 1. The above recitals and findings are incorporated herein as if set forth herein in full.

Item No: 17
SUBJECT: AMENDMENT OF TO SECTION 4-21.05 (A) ADMINISTRATIVE FINES, OF THE

ONTARIO MUNICIPAL CODE PERTAINING TO MANAGING THE CITY'S RESPONSE

TO FIREWORKS FEES AND FINES

CITY OF ONTARIO
Agenda Report
July 7, 2026
SECTION:

ADMINISTRATIVE

REPORTS/DISCUSSION/ACTION
RECOMMENDATION: That the City Council amend Section 4-21.05(a) Administrative Fines of the Ontario Municipal code relating to fines for illegal use of fireworks, pyrotechnic devices, explosives, destructive devices or their components and establishing the amount of the fees and fines set forth in this section shall be specified in the City Fee Schedule, which may only be revised by a dulyadopted resolution of the City Council.

THE FOLLOWING COUNCIL GOALS ARE BEING ACHIEVED:

Maintain the Current High Level of Public Safety
Operate in a Businesslike Manner
FISCAL IMPACT: This recommended action amends the fee structure from Section 4-21.5(a) of the Ontario Municipal Code and provides for the revenue fee structure to be included in the City Fee Schedule that will be presented to City Council in separate actions for consideration approved by Resolution.

BACKGROUND & ANALYSIS: The Ontario City Council is committed to safeguarding the health, safety, and welfare of its residents and maintaining a high quality of life throughout the community.

As such, it is the City's priority to protect its residents from activities such as the use of illegal fireworks.

Illegal fireworks pose a significant threat to public safety and community well-being. Their use increases the risk of residential, commercial, and vegetation fires. Fireworks-related incidents can result in serious injuries, property damage, and disruptions to critical infrastructure. Additionally, the illegal use of fireworks places increased demands on fire, law enforcement, and emergency medical personnel, requiring the diversion of resources from other emergency incidents and public safety priorities.

Beyond the immediate safety concerns, illegal fireworks negatively impact the quality of life for residents by generating excessive noise, disturbing families, seniors, and individuals with medical 1142
conditions, and triggering stress and anxiety for veterans and others affected by post-traumatic stress disorder (PTSD). Fireworks also contribute to environmental pollution through smoke, litter, and chemical residue, while causing distress to pets and wildlife. Collectively, these impacts create substantial financial and operational costs for the community and underscore the importance of continued enforcement, public education, and prevention efforts.

In an effort to deter the use of illegal fireworks, on Tuesday June 23, 2026, City Council directed Staff to create an escalating fee structure of $1,000 for a first citation, $2,000 for a second citation, and $3,000 for a third citation and to be specified in the City Fee Schedule, which may only be revised by a duly-adopted resolution of the City Council. 1143
