6. DISCUSSION AND BACKGROUND
The Community Services Department maintains City fountains located at the Civic Center, Main Library, Plaza Park, and Veterans Memorial at Depot Park. These fountains are prominent features in the City, with the Plaza and Main Library fountains having important historical significance. All fountains receive routine maintenance twice weekly. The scope of services also includes a one hour response time to emergencies, 24 hours/day, and seven days/week. The agreement with the current vendor expires February 28, 2022.

The Community Services Department solicited bids for fountain maintenance, consistent with the current scope of services, for a four-year agreement. Three bids were received:

2. Advanced Aquatic Technology, Inc. Orange, CA $ 69,352

3. Service First Santa Ana, CA $ 181,440
California Waters Development, Inc. (California Waters) submitted the lowest responsible bid.

Additionally, staff also verified the qualifications of the contractor with references provided for similar services. When compared to the base annual rates in the current agreement, the overall expense increased by approximately 2%, which is consistent with the cost of living increases in the current agreement.

In addition to the annual amounts, the contract includes an overall 20% contingency. Given the historical value of the fountains and the aging infrastructure supporting each fountain’sfunction, staff is recommending a 20% contingency applicable to each year of the agreement to address any unforeseen conditions or repairs over the next four years. The total aggregate cost of the four-year agreement, including contingency, is $76,510.80. A bid abstract is attached.

The term of this agreement will be March 1, 2022 through February 28, 2026. Sufficient funds are available in the General Fund (100) for the proposed agreement. Funding for the remaining years of the agreement is dependent upon City Council approval of the annual budget.
