Award of Contract to RS Construction and Development, Inc. for Community Development Block Grant Americans with Disabilities Act, El Modena Branch Library Bathroom Remodel; Bid No. 21-
22.26. 2. SUMMARY
Bids for Community Development Block Grant Americans with Disabilities Act, El Modena Branch Library Bathroom Remodel were received and opened on March 17, 2022. Three bidders responded to the notice Inviting Bids. The apparent lowest bidder is RS Construction & Development, Inc. of Upland, California in the amount of $139,440.
3. RECOMMENDED ACTION
1. Authorize the appropriation transfer of $115,000 from expenditure account number 310.9645.57130.11070, Community Development Block Grant - Contingency Account to expenditure account number 310.9645.56020.30161, Community Development Block Grant - ADA El Modena Branch Library Bathroom Remodel.
2. Approve the contract with RS Construction & Development, Inc. in the amount of $160,356, representing an original bid amount of $139,440, plus a 15% contingency of $20,916 for ADA El Modena Branch Library Bathroom Remodel; and authorize the Mayor and City Clerk to execute on behalf of the City.
4. FISCAL IMPACT
The total expenditure for this contract is $160,356 and will be funded in ADA El Modena Branch Library Bathroom Remodel (30161) through Community Development Block Grant (310).

6. DISCUSSION AND BACKGROUND

(ADA) bathrooms with door access at El Modena Branch Library. As part of this project, actuator devices will be installed along with a mechanical door opener to allow the door to be opened with ease.
The formal bid solicitation was advertised on February 17, 2022 and March 3, 2022 and bids were opened on March 17, 2022. Three bids were received as follows:
1. RS Construction & Development, Inc., Ontario $139,440
2. New Dimension General Construction, Inc., Placentia $148,600
3. Elegant Construction, Inc., Irvine $158,000
The City receives Community Development Block Grant (CDBG) funding from the U.S. Department of Housing and Urban Development for activities that primarily benefit Low and Moderate Income residents. The funding source requires that a certain percentage of the work be awarded to Disadvantaged Business Enterprises (DBE). The bidder is required to submit the Construction Contract DBE Commitment form showing how they will meet the project DBE goal, or submit the DBE information Good Faith Effort (GFE) form, documenting that adequate good faith efforts were made. Upon review of the bid received from the apparent low bidder, RS Construction & Development, Inc. has provided documentation showing its GFE.
The apparent lowest bid received is 7.7% lower than the Engineer’sEstimate. Staff checked the references and qualifications for RS Construction & Development, Inc. and found them to be acceptable, with adequate years of experience in completing contracts of similar nature to this project. Therefore, staff recommends that RS Construction & Development, Inc. be awarded the contract in the total amount of $160,356 representing an original amount of $139,440, plus a contingency of $20,916, for the Community Development Block Grant Americans with Disabilities Act El Modena Branch Library Bathroom Remodel.
Construction is scheduled to begin in May 2022 and expected to be completed within 30 calendar days.
