Agenda Item
City Council
Item #: 3.7. 5/10/2022 File #: 22-0190
TO: Honorable Mayor and Members of the City Council
THRU: Rob Houston, City Manager
FROM: Leslie Hardy, Community Services Director

1. SUBJECT
First Amendment to the Agreement with Terry’sTesting, Inc. for required repair and replacement of failing backflow devices.

2. SUMMARY
The Community Services Department manages the annual testing and repair or replacement of approximately 200 backflow devices throughout the City. Backflow devices prevent harmful contaminants from entering the City’spotable water system. The City entered into an Agreement with Terry’sTesting, Inc. in October 2021 for these services. The repair cost for backflows that did not pass testing exceeds the allowable agreement amount. Therefore, staff is recommending that the City Council approve the First Amendment to the agreement with Terry’s Testing.

3. RECOMMENDED ACTION
Approve the First Amendment with Terry’sTesting, Inc. in an amount of $14,190 to make necessary repairs to multiple backflow devices throughout the City, and authorize the Mayor and City Clerk to execute on behalf of the City.

4. FISCAL IMPACT
The total expenditure for the First Amendment is $14,190 will be funded through General Fund (100).

5. STRATEGIC PLAN GOALS
Goal 3: Enhance and Promote Quality of Life in Community a: Renovate, maintain, develop, and expand public use places and spaces

6. DISCUSSION AND BACKGROUND
The purpose of a backflow prevention device is to prevent harmful contaminants from entering the City’spotable water supply systems. The device allows water to flow in one direction and prevents water from flowing in the opposite direction. Maintaining backflow devices prevents the potential for water contamination and fines to the City. The Community Services Department manages the annual testing, repair, and replacement of approximately 200 backflow devices throughout the City including the devices at parks, City facilities, right-a-ways, and landscape assessment districts. All backflow prevention devices require annual testing to be completed by a licensed contractor.

Should a device fail during testing, it will require to be either repaired or replaced. The number and City of Orange Printed on 5/5/2022Page 1 of 2

Item #: 3.7. 5/10/2022 File #: 22-0190
Should a device fail during testing, it will require to be either repaired or replaced. The number and costs of repairs and replacements needed are unknown until annual testing is complete. After the completion of the testing last fall, the contractor determined that several backflow devices required repair or replacement due to aging infrastructure.

The City Manager executed the current agreement with Terry’sTesting, Inc. (Terry’sTesting) for a one -year term from October 1, 2021 to September 30, 2022 which included one year of testing and repairs up to $30,000. Considering the required costs for testing and given the volume of repairs needed this year, combined with the overall increase in maintenance labor and materials costs, the total amount needed will exceed the contract authority of $30,000 for this service. Staff is recommending Council approve this First Amendment with Terry’sTesting in the amount of $14,190, bringing the total contract amount to $44,190.

The associated expense will be funded through the General Fund (100).
