6. DISCUSSION AND BACKGROUND
Over the past few years, the City has employed Lyons Security Services Inc. (Lyons), a private security firm, to patrol City parks during non-operating hours. This strategy has proven very effective in increasing park safety by reducing illegal activity such as drug use and vandalism, as well as ensuring compliance with park closure hours. ensuring compliance with park closure hours. A security presence acts as a deterrent to these illicit behaviors, and, in most cases, Lyons is successful in gaining public compliance with City ordinances.

Lyons works closely with the Orange Police Department (OPD) in cases where further enforcement is required.

The City Council approved the current four-year Agreement with Lyons in May of 2020 to provide security patrols for our parks during park closure hours. In May of 2021, the City Manager executed the first amendment to the Agreement, adding the Old Towne West Metrolink Parking Structure to the service area and dedicating hours for patrol of the parking structure. In February 2022, the City Council approved the second amendment to the Agreement, allowing for increased park patrol services at El Camino Real Park during daytime hours.

In March 2022, the City Manager executed the third amendment to the Agreement, in support of the City’splan to provide onsite services for its unhoused community, a population that has been affected by COVID-19, as Mary’sKitchen vacates the property located at 517 W. Struck Avenue. Services include providing 24 hours/day of security for the rented shower, laundry, and restroom facilities, beginning the week of April 25, 2022. Starting May 2, 2022, unhoused individuals seeking assistance will have access to these facilities onsite, Monday-Saturday from 9am-3pm. During the hours of operation, security will encourage individuals to follow proper protocol, thus helping to reduce the spread of COVID-19. The third amendment also added $18,000 in compensation for this service for the first three- and one-half weeks of the transition plan.

The City is committed to providing security services during this transition period for no less than a year, unless otherwise directed by the Court, which includes providing 24 hour security. Based on the approved rates in the original contract, the associated cost for these additional service hours is $253,352.06. Therefore, staff is recommending that the City Council approve the proposed fourth amendment adding $253,352.06 to the contract compensation to provide security for the remainder of the transition plan, bringing the total not-to-exceed to $763,352.06.

At its April 12, 2022 meeting, the City Council appropriated $746,884.76 in Community Development Block Grant funding (310) for the 517 W. Struck Avenue Transition Plan. This funding will be used to cover $95,480.48 for security during operational hours. The remaining $157,871.58 for security for nonoperational hours will be covered through an appropriation from the General Fund unreserved fund balance. Should additional funding be required for this or any other transition plan services, staff would return to the City Council with an additional appropriation request.
