1. SUBJECT
Fourth Amendment to Attorney Services Agreement with Liebert Cassidy Whitmore to provide legal services with respect to personnel matters.
2. SUMMARY
The City currently has an agreement and three amendments with Liebert Cassidy Whitmore to provide legal services related to personnel matters for a total amount of $155,000, which has been expended. The proposed Fourth Amendment will increase the agreement amount by $100,000 for a total of $255,000.
3. RECOMMENDED ACTION
1. Approve a Fourth Amendment to Attorney Services Agreement with Liebert Cassidy Whitmore in the amount of $100,000; and authorize the Mayor and City Clerk to execute on behalf of the City.
2. Authorize the appropriation of $100,000 from the General Fund unreserved fund balance to expenditure account number 100.0301.51611.00000, General Fund - Personnel Legal Services.
4. FISCAL IMPACT
The total expenditure for this amendment is $100,000 and will be funded through General Fund (100).

6. DISCUSSION AND BACKGROUND
The City has retained the law firm of Liebert Cassidy Whitmore to provide legal services with respect to personnel matters.
While the City Attorney’s Office handles most of the day-to-day personnel legal matters, the City does contract with outside counsel when there is a need for a particular expertise, or the workload requires it. Liebert Cassidy Whitmore advises regarding highly technical and confidential labor and employment matters. As this agreement has been amended from time to time, as needed, staff finds it reasonable to request an additional $100,000 due to the unknown outcome and possibility of legal costs for appeals including arbitration, trial, and resolution of pending matters.

For this reason, additional funds are needed to pay these ongoing legal costs.
