6. DISCUSSION AND BACKGROUND
The State of California Office of Emergency Services (CalOES) is required to establish a protocol for the examination and treatment of victims of sexual abuse and the collection and preservation of evidence therefrom.
Existing law prohibits costs incurred for the medical examination from being charged to a victim of the assault. As a result, the cost of a medical examination performed by a qualified health care professional, hospital, or other emergency medical facility for a victim of sexual assault is treated as a local cost and charged to the local law enforcement agency in whose jurisdiction the alleged offense was committed. Effective July 16, 2021, the bill also authorizes local law enforcement agencies to seek reimbursement from CalOES to offset the cost of examinations for victims of sexual assault.
The established rate reimbursed by OES is determined by reporting criteria provided at the time of the examination, up to $1,127 per examination.
