Item: 7.2. Sully Miller Site Update
eComment: The staff report regarding the Sully Miller Update is incomplete, and not factual. The current operation is not an IDEFO. It is currently listed in documented trial as an Illegal Type A Waste Disposal Facility. Item C. in this report states that the portion of the property south of Maybury Ranch, and north of Santiago Creek is not subject to enforcement by regulatory agency. That statement is false. Currently those parcels APN numbers, are under LEA enforcement as stated in the 2020 LEA hearing. Also the Water Board issued the NOV in April, and to this date the gas tanks in Santiago Creek have not been removed. There are currently no grading permits issued from the city of Orange, to allow any of this property to be an IDEFO. The city of Orange has not issued any permits for any slated project, for this to be called an IDEFO.
This is under the Barclays Official California Code of Regulations 17388.3. "Inert Debris Engineered Fill Operations".This report has not mentioned Cal Recycles request for a Geo Technical report work plan that is currently being requested by the state.
