6. DISCUSSION AND BACKGROUND
In 2000, the City Council authorized a License Agreement with the Orange Public Library Foundation to operate a paid parking lot during the annual Orange International Street Fair (OISF) for fundraising purposes. In 2011, the City Council further granted the use of the City Hall public parking lot to Orange Elderly Services and Orange County Friends of Music (Orange Community Master Chorale) for the same purpose. In 2015 and 2018, the City Council approved additional three-year License Agreements with these three organizations, which expired earlier this year. In addition to these three parking lots, three additional lots have been available for use by other nonprofit groups for the same purpose through an annual lottery process. The nonprofit groups rely on the use of the public parking lots as a major fundraiser during the three-day event.

The following public parking lots are available for nonprofit organizations during OISF:
· Lot 1A: City Hall East (100 Spaces) - Orange Elderly Services City of Orange Printed on 7/7/2022Page 1 of 2

· Lot 1B: City Hall West (53 Spaces) - Orange County Friends of Music · Lot 2: Main Library (153 Spaces) - Orange Public Library Foundation · Lot 3: East Almond (36 Spaces)
· Lot 4: Lemon Street (24 spaces)
· Lot 5: West Almond (26 Spaces)
To be eligible to use the public parking lots during OISF, nonprofit groups must meet certain criteria:
· Orange based nonprofit organization
· Not have a booth within the OISF footprint
· Funds raised from this activity will be directly used to benefit the Orange community · Provide sufficient adult staffing to operate the parking lot and follow City guidelines Remaining public parking lots south of Chapman Avenue not noted above, are dedicated for handicap parking, utilized by OISF for staging of equipment and vendors, and assigned to emergency personnel for the production of Street Fair. Public parking lots north of Chapman Avenue will remain free and available for the public visiting OISF and Old Towne merchants. The funding for the Old Towne West Metrolink Parking Structure prevents the City from allowing nonprofits to charge for parking at the structure for fundraising purposes. Instead, the City contracts with a parking management company during OISF, and all proceeds go towards the maintenance of the parking structure. In addition, several of the private parking lots within the footprint of the Street Fair have also established paid parking during OISF.

Staff is recommending the approval to enter into new, three-year License Agreements with Orange Elderly Services, Orange County Friends of Music, and the Orange Public Library Foundation for the lots noted above. The remaining lots will continue to be available for other interested nonprofit organizations via the annual lottery process. Nonprofit organizations selected in the lottery are also required to enter into a License Agreement with the City, which is approved by the City Manager as designated by the City Council.
