1. SUBJECT
Award of Contract to Towo Enterprise, Inc. for Annual Concrete Replacement at Various Locations, Phase I, FY 2022-23; Bid No. 22-23.09.
2. SUMMARY
Three bids for the Annual Concrete Replacement at Various Locations, Phase I, FY 2022-23 project were received and opened on October 6, 2022. The apparent low bidder is Towo Enterprise, Inc. of Fullerton, California in the amount of $422,900.
3. RECOMMENDED ACTION
Approve the contract with Towo Enterprise, Inc. in the amount of $486,335, representing an original bid amount of $422,900, plus a 15% contingency of $63,435; and authorize the Mayor and City Clerk to execute on behalf of the City.
4. FISCAL IMPACT
The total expenditure for this contract is $486,335 and will be funded in Citywide Sidewalk Assessment Program (20441) and operating expenditures through Measure M (263).

6. DISCUSSION AND BACKGROUND
The Annual Concrete Replacement Project Phase I includes a component of the annual maintenance services citywide on a scale large enough that these services require an outside contractor. As such, this contract is funded from both the Operations, and Capital Improvement Project (CIP) budgets previously approved by Council.
The formal bid solicitation was advertised on September 22 and September 29, 2022. Bids were opened on October 6, 2022. Three bids were received as follows:
1. Towo Enterprise, Inc. of Fullerton, CA $422,900

3. Leonida Builders, Inc. of Santa Clarita, CA $497,800 The bid amount is about 15% lower than the Engineer Estimate of $500,000. Staff checked the references and qualifications for Towo Enterprise, Inc. and found them to be acceptable, with adequate years of experience in completing contracts of similar nature to this project. Therefore, staff recommends that Towo Enterprise, Inc. be awarded the contract in the total amount of $486,355, representing an original amount of $422,900, plus a contingency of $63,435, for the Annual Concrete Replacement at Various Locations, Phase I, FY 2022-23.
Construction is scheduled to begin in January 2023 and expected to be completed within 90 days.
