1. SUBJECT
First Amendment to Contract with RS Construction and Development, Inc.; and Final Acceptance of Bid No. 21-22.22, Public Works and Community Development Front Counter Remodel Project and authorization to file Notice of Completion.
2. SUMMARY
The City of Orange has entered into a contract with RS Construction and Development, Inc. for the Public Works and Community Development Front Counter Remodel Project. Extra work has been added at an agreed upon lump sum in the amount of $57,500. The work has been completed to the satisfaction of the Public Works Department.
3. RECOMMENDED ACTION
1. Authorize the appropriation of $57,500 from the Capital Projects unreserved fund balance to expenditure account number 500.5028.56020.20408 Capital Projects - Public Works and Community Development Front Counter Remodel.
2. Approve the First Amendment to Contract in the amount of $57,500 to RS Construction and Development, Inc. for the additional work and authorize the Mayor and City Clerk to execute on behalf of the City.
3. Accept Public Works and Community Development Front Counter Remodel Project as complete (SP-4097), and authorize staff to file Notice of Completion with the County Recorder.
4. FISCAL IMPACT
The total expenditure for this project is $303,400 and will be funded in Public Works and Community Development Front Counter Remodel (20408) through:
Major Building Improvements (725) $245,900
Capital Projects (500) 57,500
TOTAL $303,400

6. DISCUSSION AND BACKGROUND
The City Council awarded the Public Works and Community Development Front Counter Remodel Project on April 12, 2022, to RS Construction and Development, Inc. The original scope of work included remodel of the Public Works and Community Development front counter and public lobby to provide a welcoming and attractive environment for the public, as well as to provide a work area that will better serve the public and staff.
During construction, additional remodel work was identified to assist in consolidating staffing within the City Attorney Office. This extra work was added to this contact. The work has been completed to the satisfaction of the Public Works Department. Staff is recommending that the City Council approves First Amendment to Contract in the amount of $57,500.
The original awarded contract amount for RS Construction and Development, Inc. was $245,900.
The First Amendment to Contract represent a 23% increase from the original awarded contract amount bringing the total awarded contract amount to $303,400.
