APPLICANT: CITY OF ORANGE
Moved by Chair Vazquez and seconded by Commissioner Martinez resolution be adopted:
WHEREAS, on March 9, 2010 the City adopted its 2010 General Plan, including changes to land use designations along the Katella Corridor General Plan Focus Area from Commercial Recreation to Urban Mixed Use to establish land use policy that encourages: economic development; diversification of allowable land uses; property reinvestment and redevelopment for underutilized property or development conditions that are no longer suited for present-day business needs; and opportunities for the creation of housing in proximity to employment, services, public transportation, and existing hubs of activity; and
WHEREAS, the property subject to Zone Change No. 1305-21 have had a zoning classification of Commercial Recreation, which is not consistent with the Urban Mixed Use General Plan land use designation; and
WHEREAS, California Government Code Section 65860 requires consistency between a city's General Plan and zoning designations; and
WHEREAS, the Planning Commission, having considered the proposed Ordinance and Zone Change at a public hearing held on September 19, 2022, including review of the staff report and having received public testimony, has determined the proposed amendment is justified and recommends approval thereof; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends the City Council adopt an Ordinance establishing the subject Zone Change, as depicted on maps included in Attachment A to this Resolution, attached hereto, based on the following findings:
SECTION 1- FINDINGS
1. The Zone Change implements the General Plan Land Use Element by establishing Urban Mixed Use zoning in an area of the City that is envisioned to transition from light-industrial use to a mixed-use urban district that provides an opportunity for citizens to live close to employment, commercial and entertainment nodes, and public transit.
Resolution No. PC 24-22
2. The Zone Change implements the General Plan Urban Design Element by establishing zoning that facilitates the creation of new commercial and mixed uses opportunities in the City on a site that has not historically been available for under-utilized due to the City's zoning regulations.
3. The Zone Change applies zoning to a property in order to achieve consistency with the City's General Plan land use designations for that property.
4. The Zone Change establishes a development framework for the site that encourages property reinvestment and accommodates a commercial use that is intended to have economic development benefits for nearby businesses and under-utilized properties.
SECTION 2-ENVIRONMENTAL REVIEW
Final Program Environmental Impact Report (EIR) No. 1815-09 for the Comprehensive General Plan Update was certified on March 9, 2010 and prepared in accordance with the California Environmental Quality Act. The proposed change in zoning is within the scope of the previously approved General Plan and is adequately described in the previously certified General Plan Program EIR for purposes of CEQA.
BE IT FURTHER RESOLVED that the Planning Commission recommends to the City Council that the City's Zoning Map be amended to incorporate the new mixed use zoning districts as depicted on maps provided in Attachment A.
I hereby certify that the Planning Commission of the City of Orange adopted the foregoing resolution on September 19, 2022 by the following vote:
