6. DISCUSSION AND BACKGROUND
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program is the primary provider of federal criminal justice funding to states and units of local government. In October 2022, the U.S.

Department of Justice approved the application for funding under the 2022 Edward Byrne Memorial JAG Program. The joint allocation amount awarded to the County of Orange is $464,954, of which $11,963 was awarded to the City of Orange Police Department to support the purchase of tactical City of Orange Printed on 1/5/2023Page 1 of 2

shields for front-line officers.

As a condition of past awards, the Bureau of Justice Assistance imposed an administrative requirement for JAG award recipients that are not compliant in the National Incident Based Reporting System (NIBRS), to dedicate three percent of their JAG award toward full compliance of the FBI’s NIBRS data submission requirement. For the 2022 JAG grant, a NIBRS set-aside is no longer required; however, JAG recipients are encouraged to continue working toward NIBRS compliance. As of June 2022, the department completed implementation of the NIBRS module. To become NIBRS certified, agencies must submit incident-based data for six consecutive months and sustain an error rate of four percent or less for three separate, consecutive data submissions. At this time, the department continues to work with the Criminal Justice Information Services Division to become NIBRS certified. The department’s error rate is currently six percent.

The Orange Police Department’s2022 jurisdictional project identified the need to secure rifle rated tactical shields necessary to resolve critical incidents. There is a unanimous agreement that new tactical shields for patrol be rifle rated, lightweight, and include a viewport to maneuver through various obstacles. Current shields, assigned to patrol sergeant vehicles, do not have the same caliber rating, are heavier, and less maneuverable compared to modern tactical shields. In addition, shields with desired caliber rating reside with the department’sSpecial Weapons and Tactics team.

The addition of rifle rated tactical shields will be deployed to patrol sergeant vehicles, who are first on scene, to effectively manage any threat level. Tactical shields are essential in helping minimize injuries to safety personnel, enhance safety, and allow the department to better serve the community.

The department intends to purchase four additional rifle rated tactical shields to outfit patrol officers.

The cost per shield is approximately $3,535; for a total cost of approximately $15,367 including tax and shipping. The proposed JAG Grant will provide funding up to $11,963, and the remaining costs will be funded from Asset Forfeiture (355).

The County of Orange is requesting approval of an agreement that allocates the City’s2022 JAG funds as follows: $1,329 for grant administrative fees and $11,963 retained by the City.
