6. DISCUSSION AND BACKGROUND
Background
The City has offered the family-based 3rd of July Celebration annual event to the community for the last 27 years. This event brings approximately 10,000 community members together to celebrate our Nation’sbirthday. Since its inception, in addition to the musical program provided by the Orange Community Master Chorale, a professional fireworks display has been a main component of this event. The City contracts with a pyrotechnic company to provide a professional, safe, and quality fireworks display. The current agreement to provide these services expired after the 2022 3rd of July Celebration.
Discussion
At the conclusion of the most recent agreement, staff solicited vendors and confirmed that Pyro Spectaculars, Inc. (Pyro) is the only local vendor available to provide the necessary services on the specified date. Zambelli Fireworks, the only alternative fireworks vendor in the area, informed staff City of Orange Printed on 1/5/2023Page 1 of 2

specified date. Zambelli Fireworks, the only alternative fireworks vendor in the area, informed staff they would decline the opportunity to participate in a formal Request for Proposal (RFP) due to other events scheduled on July 3. Pyro has been the City’sprovider of fireworks at this event since 2000 and has provided high quality customer service and colorful firework displays.
As a result, staff is recommending the approval of a five-year agreement with Pyro Spectaculars for the 2023-2027 3rd of July Celebration firework displays. The scope of work includes 14-minute fireworks display as provided previously. Both a payment and cancellation schedule are included.
The annual cost is $25,000 per year, for a total of $125,000 over the five-year term. This is an additional $7,500 per year when compared to the prior agreement. Pyro noted the increase is due to the rising cost of inventory. When surveying other municipal agencies who offer firework displays, it was confirmed that this is a competitive price and reasonable increase. Sufficient funds for the 2023 fireworks display are included in the Fiscal Year 2022-23 (FY23) department budget. Funds to cover the fireworks display beyond FY23 will need to be included in future fiscal year annual budget appropriations.
