1. SUBJECT
Employment Agreement with City Attorney Mary E. Binning.
2. SUMMARY
Pursuant to Resolution No. 11410, or as superseded, the City Council determines the City Attorney’s compensation and benefits. The proposed Employment Agreement with City Attorney Mary E.
Binning provides for a six month term effective January 15, 2023 thru July 14, 2023.
3. RECOMMENDED ACTION
Approve Employment Agreement with City Attorney Mary E. Binning.
4. FISCAL IMPACT
The Agreement provides for a monthly salary of $22,750.00 plus benefits, as outlined in the Executive/Senior Management Resolution No. 11410, or as superseded.
Funds are budgeted and available as follows: General Fund (100) will pay 90% of the expenses related to this Agreement, with 5% from Self Insurance - Workers’Compensation (730), and the other 5% from Self Insurance - Liability (740).

6. DISCUSSION AND BACKGROUND
The City hired Ms. Binning in March 1998 where she served as Assistant City Attorney until December 2000 and was rehired with the City as a Senior Assistant City Attorney in March 2019.
Ms. Binning offers nearly 30 years of municipal and private law experience.
In recognition of Ms. Binning’s significant experience, the City shall provide 80 hours of Administrative Leave, 22.5 hours of Floating Holiday Leave, and a modification to the Sick Leave Payout Program (from 50% to 75% of unused sick leave hours) upon retirement.
Applicable rules and regulations for Executive Directors within Resolution No. 11410, and the Orange Municipal Code, as superseded, govern all other benefits or terms of employment.
